Abbott<\/strong><\/h3>\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-645.pdf\">Cour supr\u00eame des \u00c9tats-Unis, 17 mai 2010<\/a><\/p>\n<p><strong>Quand avez-vous la \"garde\" au sens de la Convention ?<\/strong><\/p>\n<p><strong>Dans l'affaire Abbott contre Abbott, la Cour Supr\u00eame a d\u00e9cid\u00e9 qu'un... <em>ne exeat<\/em> L'ordonnance donne un droit de garde au parent non gardien en vertu de la Convention de La Haye sur l'enl\u00e8vement international d'enfants.\u00a0<\/strong><\/p>\n<p>Les parents ont d\u00e9m\u00e9nag\u00e9 des \u00c9tats-Unis au Chili avec leur fils, qui est n\u00e9 aux \u00c9tats-Unis. Plus tard, les parents ont divorc\u00e9 au Chili. Le tribunal a alors accord\u00e9 \u00e0 la m\u00e8re la garde de leur fils et n'a accord\u00e9 au p\u00e8re qu'un droit de visite. En outre, \u00e0 la demande de la m\u00e8re, le tribunal a d\u00e9livr\u00e9 un certificat d'adoption. <em>ne exeat<\/em> ordonnance. Cette ordonnance interdit \u00e0 l'un des parents de retirer l'enfant du Chili sans l'accord des deux parents.<\/p>\n<p>Malgr\u00e9 cette d\u00e9cision, la m\u00e8re a amen\u00e9 le fils aux \u00c9tats-Unis, sans le consentement du p\u00e8re. Le p\u00e8re demande au tribunal am\u00e9ricain une d\u00e9cision de retour fond\u00e9e sur la Convention de La Haye. Il fait valoir que la <em>ne exeat<\/em> l'ordonnance lui donne un droit de garde au sens de la Convention. Son avis se fonde sur les \u00e9l\u00e9ments suivants.<\/p>\n<h3><strong>La garde d'enfants dans la Convention<\/strong><\/h3>\n<p>L'art. L'article 3 de la Convention stipule qu'un \"d\u00e9placement illicite\" est celui qui se produit \"en violation du droit de garde ; ...\".<\/p>\n<p>L'Art. 5 de la Convention stipule que le droit de garde comprend \"le droit de prendre soin de la personne de l'enfant et, en particulier, le droit de d\u00e9terminer le lieu de r\u00e9sidence de l'enfant\".<\/p>\n<p>Le p\u00e8re fait valoir que la Convention de La Haye a voulu que le droit de garde soit un concept autonome, ind\u00e9pendant de la mani\u00e8re dont le droit de garde est sp\u00e9cifiquement d\u00e9fini par les lois d'un pays particulier. Mais la m\u00e8re fait valoir que le droit de garde est un droit positif dans la d\u00e9termination du lieu de r\u00e9sidence de l'enfant, et qu'un droit de garde ne peut \u00eatre exerc\u00e9 que dans le cadre de la Convention de La Haye. <em>ne exeat<\/em> n'est pas un droit affirmatif.<\/p>\n<p>Dans l'affaire Abbott contre Abbott, la Cour Supr\u00eame a d\u00e9cid\u00e9 que le... <em>ne exeat<\/em> L'ordonnance a donn\u00e9 au p\u00e8re un droit de garde. Cela donnait au p\u00e8re la possibilit\u00e9 de demander le retour imm\u00e9diat du fils sur la base de l'art. 12 de la Convention.<\/p>\n<h3><strong>Application coh\u00e9rente<\/strong><\/h3>\n<p>C'est \u00e9galement la vision des autres pays signataires du trait\u00e9. Cette vision est conforme \u00e0 celle du Bureau permanent de la Convention de La Haye de droit international priv\u00e9 (Bureau permanent), qui pr\u00e9conise une application coh\u00e9rente de la Convention pour maintenir la confiance mutuelle entre les pays contractants.<\/p>\n<p>Pour les Etats membres de l'UE (\u00e0 l'exception du Danemark), la port\u00e9e du terme \"garde\" est pr\u00e9cis\u00e9e \u00e0 l'art. 2 sub 11, b de Bruxelles II bis : \"la garde est r\u00e9put\u00e9e exerc\u00e9e conjointement si l'une des personnes qui, en vertu d'une d\u00e9cision ou de la loi, exerce la responsabilit\u00e9 parentale ne peut fixer le lieu de r\u00e9sidence de l'enfant sans le consentement d'une autre personne exer\u00e7ant la responsabilit\u00e9 parentale.<\/p>\n<h3><strong>Qu'est-ce que cela signifie pour les autres parents ? <\/strong><\/h3>\n<p>Cela signifie que les parents ayant un pass\u00e9\/une vie internationale peuvent, au cours d'une proc\u00e9dure de divorce ou plus tard lorsqu'ils craignent un enl\u00e8vement d'enfant, demander au tribunal de d\u00e9cider que leur consentement est n\u00e9cessaire pour un d\u00e9m\u00e9nagement international de l'enfant. (Cette demande sera tr\u00e8s probablement fond\u00e9e sur le fait qu'un d\u00e9m\u00e9nagement international interf\u00e9rerait avec les droits de visite).
