Un enfant peut-il avoir deux r\u00e9sidences habituelles ?<\/strong><\/p>\n

La Cour d'appel de La Haye a chang\u00e9 d'avis \u00e0 ce sujet. Elle a maintenant d\u00e9cid\u00e9 qu'un enfant ne peut avoir qu'une seule r\u00e9sidence habituelle. M\u00eame lorsque les parents ont v\u00e9cu alternativement dans deux pays diff\u00e9rents avec l'enfant, il ne peut y avoir qu'une seule r\u00e9sidence habituelle. Cette r\u00e9sidence est essentielle pour que la Cour puisse d\u00e9cider si l'enfant a \u00e9t\u00e9 enlev\u00e9 de ce pays ou non.<\/strong><\/p>\n

Deux appartements<\/strong><\/h3>\n

Cette affaire concerne deux parents qui se sont rencontr\u00e9s en Espagne en 2016. L'homme y louait un appartement. La m\u00e8re a v\u00e9cu en Espagne et a \u00e9t\u00e9 enregistr\u00e9e aupr\u00e8s de la municipalit\u00e9 n\u00e9erlandaise comme ayant une adresse en Espagne. M\u00eame si le couple passe \u00e9galement du temps dans son appartement aux Pays-Bas, la Cour d'appel estime qu'il passe la majeure partie de son temps en Espagne.<\/p>\n

N\u00e9 et \u00e9lev\u00e9<\/strong><\/h3>\n

En outre, les enfants sont n\u00e9s en Espagne \u00e0 la suite d'une d\u00e9cision mutuelle des parents. Apr\u00e8s leur naissance, ils ont pass\u00e9 des mois en Espagne, jusqu'\u00e0 ce que la m\u00e8re emm\u00e8ne les enfants aux Pays-Bas. Bien que le p\u00e8re ait pass\u00e9 du temps aux Pays-Bas en raison de ses autres enfants, et du temps dans d'autres pays pour des raisons professionnelles, la Cour d'appel estime que l'Espagne \u00e9tait sa base.<\/p>\n

La demande de divorce<\/strong><\/h3>\n

La Cour d'appel accorde \u00e9galement du poids au texte de la demande de divorce de la m\u00e8re. Elle a demand\u00e9 le divorce aux Pays-Bas et dans cette demande elle a \u00e9crit que les parties ont d\u00e9m\u00e9nag\u00e9 en Espagne en 2017, ont v\u00e9cu en Espagne jusqu'\u00e0 ce que la m\u00e8re parte aux Pays-Bas en 2018, o\u00f9 elle a maintenant sa r\u00e9sidence habituelle. La Cour d'appel ne peut pas voir dans ce texte une reconnaissance judiciaire de la r\u00e9sidence habituelle des parties. Mais la Cour d'appel consid\u00e8re que ce texte est pertinent pour la d\u00e9termination de la r\u00e9sidence habituelle des enfants.<\/p>\n

Deux r\u00e9sidences habituelles ?<\/h3>\n

Dans un arr\u00eat de la Cour d'appel du 27 juillet 2016 (ECLI:NL:GHDHA:2016:2502<\/a>), la Cour d'appel avait d\u00e9cid\u00e9 que l'enfant qui vivait alternativement avec chacun des parents, qui vivaient dans des pays diff\u00e9rents, avait deux r\u00e9sidences habituelles. Dans cet arr\u00eat ult\u00e9rieur du 3 avril 2019, la Cour d'appel se r\u00e9f\u00e8re \u00e0 l'arr\u00eat de la Cour europ\u00e9enne des droits de l'homme. arr\u00eat de la Cour de justice de l'Union europ\u00e9enne<\/a> du 22 d\u00e9cembre 2010. Dans cet arr\u00eat, la Cour de justice a d\u00e9cid\u00e9 qu'un enfant ne peut pas avoir deux r\u00e9sidences habituelles. Cette d\u00e9cision a \u00e9t\u00e9 rendue dans une affaire bas\u00e9e sur l'article 8 de Bruxelles II bis, mais la Cour d'appel a repris cette d\u00e9cision dans le cadre de cette affaire bas\u00e9e sur l'art. 12 de la Convention de La Haye.<\/p>\n

Conclusion<\/strong><\/h3>\n

Dans cette affaire, la Cour d'appel conclut que les enfants avaient leur r\u00e9sidence habituelle en Espagne et que la m\u00e8re les a emmen\u00e9s aux Pays-Bas sans le consentement du p\u00e8re. La Cour d'appel d\u00e9cide que la m\u00e8re doit retourner en Espagne.<\/p>\n

Qu'est-ce que cela signifie pour les autres parents ?<\/strong><\/h3>\n

La r\u00e9sidence habituelle du mineur doit \u00eatre d\u00e9termin\u00e9e par le tribunal sur la base des faits et des circonstances propres \u00e0 chaque cas. \u00c9tant donn\u00e9 qu'il ne peut y avoir qu'une seule r\u00e9sidence habituelle, les parents doivent discuter de tous les d\u00e9tails \u00e0 ce sujet avec leurs avocats afin de d\u00e9terminer ceux qui sont pertinents.\u00a0<\/span><\/p>\n
