L'enfant sera pi\u00e9g\u00e9 entre les parents, donc il ne peut y avoir de garde conjointe ?<\/strong><\/p>\n

La m\u00e8re n'obtient pas la garde exclusive car elle agit contre les int\u00e9r\u00eats de la fille en n'offrant au p\u00e8re aucune possibilit\u00e9 de s'impliquer dans la vie de la fille. La Cour consid\u00e8re que cette d\u00e9cision est justifi\u00e9e, m\u00eame si le crit\u00e8re dit \" pi\u00e9g\u00e9 ou perdu \" est rempli, car l'enfant a \u00e9t\u00e9 plac\u00e9e sous la surveillance des services de protection de l'enfance. La Cour supr\u00eame ne consid\u00e8re pas que cette d\u00e9cision soit contraire \u00e0 l'art. 1 : 251a paragraphe 1 du Code civil n\u00e9erlandais. Par cons\u00e9quent, la Cour supr\u00eame choisit la garde conjointe malgr\u00e9 les probl\u00e8mes entre les parents.<\/span><\/strong><\/p>\n

Le tribunal avait rejet\u00e9 la demande de la m\u00e8re d'obtenir la garde exclusive de sa fille. La Cour d'appel a confirm\u00e9 cette d\u00e9cision.<\/span><\/p>\n

Ali\u00e9nation parentale<\/strong><\/h3>\n

Ali\u00e9nation parentale La commission de protection de l'enfance avait conseill\u00e9 de maintenir la garde conjointe. Le conseil estimait que la situation dans laquelle le p\u00e8re \u00e9tait banni de la vie de la fille par la m\u00e8re et dans laquelle l'ali\u00e9nation parentale \u00e9tait cr\u00e9\u00e9e \u00e9tait cr\u00e9\u00e9e exclusivement par la m\u00e8re. Le conseil ne s'attend pas \u00e0 ce que la situation s'am\u00e9liore \u00e0 court terme. La m\u00e8re n'accepte que l'aide qu'elle juge appropri\u00e9e. De plus, la m\u00e8re agit contre les int\u00e9r\u00eats de la fille en recherchant les m\u00e9dias et la publicit\u00e9. Le conseil est donc tr\u00e8s inquiet pour la fille. Non pas pour les soins quotidiens, mais pour le d\u00e9veloppement \u00e0 long terme de sa personnalit\u00e9. Le conseil a m\u00eame envisag\u00e9 un placement hors du foyer familial pour sortir de cette situation.<\/span><\/p>\n

Pi\u00e9g\u00e9 ou perdu<\/span><\/strong><\/h3>\n

La Cour d'appel a consid\u00e9r\u00e9 qu'il existe un risque inacceptable que la fille soit pi\u00e9g\u00e9e ou perdue entre les parents sans qu'aucune am\u00e9lioration ne soit pr\u00e9vue dans un avenir pr\u00e9visible. Toutefois, la Cour d'appel est d'avis qu'il est dans l'int\u00e9r\u00eat de la fille que les parents aient la garde conjointe. Selon la Cour d'appel, la m\u00e8re n\u00e9glige grossi\u00e8rement son obligation de favoriser le d\u00e9veloppement des liens entre la fille et son p\u00e8re. La Cour d'appel est d'avis que la m\u00e8re agit si clairement contre les int\u00e9r\u00eats de la fille qu'il serait irresponsable pour elle d'avoir la garde exclusive de la fille. La Cour d'appel consid\u00e8re que cette d\u00e9cision est justifi\u00e9e, m\u00eame si le crit\u00e8re dit \"pi\u00e9g\u00e9 ou perdu\" est rempli, car l'enfant a \u00e9t\u00e9 plac\u00e9e sous la surveillance des services de protection de l'enfance.<\/span><\/p>\n

Mari\u00e9 ou non <\/span><\/strong><\/h3>\n

La Cour supr\u00eame estime que l'art. 1 : 253c alin\u00e9a 2 du Code civil n\u00e9erlandais (obtention de la garde exclusive par des parents non mari\u00e9s) et l'art. 1 : 251 a paragraphe 1 BW (garde exclusive apr\u00e8s le divorce) doivent \u00eatre interpr\u00e9t\u00e9s de la m\u00eame mani\u00e8re. Dans les deux situations, l'autorit\u00e9 conjointe est le point de d\u00e9part et la garde exclusive est l'exception. <\/span><\/p>\n

La Cour supr\u00eame estime en outre qu'une demande visant \u00e0 obtenir la garde conjointe peut<\/em> ne peut \u00eatre rejet\u00e9e que pour les deux motifs mentionn\u00e9s (le crit\u00e8re du pi\u00e8ge ou de la perte est rempli ou le rejet de la demande est par ailleurs dans l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant), mais qu'il n'en d\u00e9coule pas qu'elle doit<\/em> \u00eatre rejet\u00e9 si l'une des conditions est remplie. Aussi pour l'art. 1 : 251 a paragraphe 1 du Code civil s'applique que le tribunal peut<\/em> accorder la garde \u00e0 l'un des parents en cas de divorce si l'un des motifs mentionn\u00e9s se produit. Dans les deux situations (les parents divorcent \/ les parents n'ont jamais \u00e9t\u00e9 mari\u00e9s), le juge a donc la possibilit\u00e9 de maintenir la garde conjointe.<\/span><\/p>\n

La vie de famille<\/strong><\/h3>\n

Enfin, la Cour supr\u00eame souligne que cette explication est conforme au principe selon lequel les d\u00e9cisions de ce type doivent tenir compte autant que possible de l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant. Dans un cas comme celui-ci, o\u00f9 le parent gardien n'offre aucunement \u00e0 l'autre parent la possibilit\u00e9 de s'impliquer dans la vie de l'enfant, l'attribution de la garde conjointe est l'un des outils que le juge devrait pouvoir utiliser pour r\u00e9aliser le droit \u00e0 la vie familiale entre l'enfant et l'autre parent. Alors que la garde conjointe comporte le risque que l'enfant soit coinc\u00e9 entre les deux parents, la garde exclusive a pour cons\u00e9quence que l'autre parent est compl\u00e8tement exclu de la vie de l'enfant. En se basant sur la situation au moment de sa d\u00e9cision, le juge doit alors pouvoir estimer lequel des deux maux est susceptible de nuire le moins \u00e0 l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant.<\/span><\/p>\n

Qu'est-ce que cela signifie pour les autres parents ? <\/span><\/strong><\/h3>\n

Cette d\u00e9cision de la Cour supr\u00eame n\u00e9erlandaise est importante pour les parents qui luttent contre l'ali\u00e9nation parentale, car elle signifie que l'ali\u00e9nation parentale n'est pas r\u00e9compens\u00e9e par la garde exclusive. Le tribunal peut choisir de maintenir la garde conjointe garde \u00e0 vue<\/a> malgr\u00e9 les probl\u00e8mes entre les parents. Le fait qu'une telle d\u00e9cision aille de pair avec une ordonnance de surveillance est dans l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant, car sinon on ne peut gu\u00e8re s'attendre \u00e0 une am\u00e9lioration.<\/span><\/p>\n
