L'appel est-il inutile, si l'enfant est d\u00e9j\u00e0 rendu ?<\/strong><\/p>\n

Dans l'affaire Chafin v. Chafin, la Cour supr\u00eame des \u00c9tats-Unis a d\u00e9cid\u00e9 qu'une proc\u00e9dure d'appel ne devient pas sans objet si l'enfant est rendu en attendant l'appel.\u00a0<\/strong><\/p>\n

Dans cette affaire, le tribunal de district de l'Alabama avait d\u00e9cid\u00e9 que l'enfant devait \u00eatre renvoy\u00e9 en \u00c9cosse. Jeffrey, le p\u00e8re, \u00e9tait un soldat am\u00e9ricain. Il s'est mari\u00e9 en \u00c9cosse avec Lynne, o\u00f9 leur fille est n\u00e9e. Lorsque Jeffrey \u00e9tait en service en Afghanistan, la fille est all\u00e9e vivre avec la m\u00e8re en Allemagne. Apr\u00e8s le retour du p\u00e8re, la famille est all\u00e9e vivre en Alabama. En 2010, le p\u00e8re a demand\u00e9 le divorce. Il a \u00e9galement demand\u00e9 une garde temporaire apr\u00e8s que la m\u00e8re ait \u00e9t\u00e9 arr\u00eat\u00e9e pour agression domestique.<\/p>\n

R\u00e9sidence habituelle en \u00c9cosse<\/strong><\/h3>\n

Apr\u00e8s son arrestation, la m\u00e8re a \u00e9t\u00e9 expuls\u00e9e, car il est apparu qu'elle avait d\u00e9pass\u00e9 la dur\u00e9e de validit\u00e9 de son visa. La m\u00e8re a alors demand\u00e9 au tribunal am\u00e9ricain de d\u00e9cider que la fille devait \u00eatre renvoy\u00e9e en \u00c9cosse, afin qu'un tribunal \u00e9cossais puisse d\u00e9cider de sa garde. La m\u00e8re a affirm\u00e9 que l'enfant avait sa r\u00e9sidence habituelle en \u00c9cosse.<\/p>\n

Demande de sursis \u00e0 ex\u00e9cution de l'ordonnance<\/strong><\/h3>\n

Le tribunal a alors acc\u00e9d\u00e9 \u00e0 sa demande et ordonn\u00e9 au p\u00e8re de payer les frais de justice de la m\u00e8re. Apr\u00e8s cela, le p\u00e8re a annonc\u00e9 son intention de faire appel de la d\u00e9cision, et a demand\u00e9 que l'ordonnance du tribunal soit suspendue jusqu'\u00e0 ce que l'appel soit entendu. Cependant, le tribunal a refus\u00e9 de suspendre la d\u00e9cision en attendant l'appel. Le m\u00eame jour, la fille est partie pour l'\u00c9cosse.<\/p>\n

L'affaire est sans objet<\/strong><\/h3>\n

La Cour d'appel des \u00c9tats-Unis a refus\u00e9 d'entendre sa contestation. Elle a d\u00e9clar\u00e9 que l'affaire \u00e9tait sans objet, \u00e9tant donn\u00e9 que la fille \u00e9tait d\u00e9j\u00e0 retourn\u00e9e en \u00c9cosse. En cons\u00e9quence, la cour d'appel a rejet\u00e9 son recours, ordonnant au contraire au tribunal de district d'annuler la d\u00e9cision de retour et de rejeter l'ensemble de l'affaire.<\/p>\n

Le p\u00e8re a ensuite fait appel devant la Cour supr\u00eame, qui a accept\u00e9 l'affaire. L'une des raisons de l'acceptation de l'affaire \u00e9tait qu'une autre cour d'appel avait statu\u00e9 en 2013 que les cours d'appel restaient comp\u00e9tentes dans de telles situations.<\/p>\n

La convention de La Haye n'aborde pas cette situation.<\/p>\n

Toujours la juridiction<\/strong><\/h3>\n

La Cour supr\u00eame a conclu que les tribunaux am\u00e9ricains \u00e9taient toujours comp\u00e9tents et que le syst\u00e8me judiciaire am\u00e9ricain pouvait toujours ordonner \u00e0 la m\u00e8re de rendre l'enfant. Elle a \u00e9galement not\u00e9 que, m\u00eame si la m\u00e8re ignorait un r\u00e9sultat d\u00e9favorable, cela n'emp\u00eachait pas l'affaire d'\u00eatre port\u00e9e en appel, et que les tribunaux \u00e9cossais qui statuaient simultan\u00e9ment sur le litige relatif \u00e0 la garde de l'enfant pouvaient \u00eatre influenc\u00e9s par le r\u00e9sultat de l'affaire.<\/p>\n

Qu'est-ce que cela signifie pour les autres parents ?<\/strong><\/h3>\n

Il est compr\u00e9hensible que la m\u00e8re ait renvoy\u00e9 sa fille en \u00c9cosse d\u00e8s qu'elle a appris que la demande de suspension de l'ordonnance pr\u00e9sent\u00e9e par le p\u00e8re avait \u00e9t\u00e9 rejet\u00e9e. Cependant, si le p\u00e8re avait r\u00e9ussi \u00e0 faire appel, la fille aurait d\u00fb retourner aux \u00c9tats-Unis, ce qui, selon son \u00e2ge, pourrait \u00eatre tr\u00e8s perturbant pour l'enfant (aller et retour). Ainsi, lorsqu'un parent doit d\u00e9cider s'il doit ou non partir d\u00e8s que possible, il devrait consid\u00e9rer l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant, puisque la juridiction de la cour d'appel ne sera pas affect\u00e9e par le retour rapide de l'enfant.<\/p>\n
