La Cour d'appel l'a condamn\u00e9 \u00e0 une peine d'emprisonnement de 42 mois. La Cour d'appel a \u00e9galement d\u00e9cid\u00e9 qu'il devait verser \u00e0 la m\u00e8re 15 000 euros de dommages et int\u00e9r\u00eats.\u00a0<\/strong><\/p>\n<p>Le p\u00e8re a emmen\u00e9 les jeunes enfants en \u00c9gypte en f\u00e9vrier 2005. Il est simplement all\u00e9 les chercher \u00e0 l'\u00e9cole sans que la m\u00e8re ne soit au courant. \u00c0 ce moment-l\u00e0, les enfants avaient 3 et 8 ans. Il a chang\u00e9 leurs noms. Plus tard, il a d\u00e9m\u00e9nag\u00e9 avec eux au Soudan, puis en \u00c9gypte et enfin au Royaume-Uni. Il n'a jamais inform\u00e9 la m\u00e8re de l'endroit o\u00f9 ils se trouvaient. Elle n'a donc pas pu avoir de contact avec ses enfants.<\/p>\n<h3><strong>Des noms et des lieux diff\u00e9rents<\/strong><\/h3>\n<p>En janvier 2008, la m\u00e8re a obtenu la garde exclusive des enfants. Plus tard, en 2016, elle a r\u00e9ussi \u00e0 retrouver leur adresse. Elle a alors pu revoir ses enfants cette ann\u00e9e-l\u00e0 pour la premi\u00e8re fois depuis qu'ils lui ont \u00e9t\u00e9 enlev\u00e9s. Mais elle n'a pratiquement pas eu de contact avec les enfants. La Cour a conclu qu'apr\u00e8s avoir \u00e9t\u00e9 totalement d\u00e9pendants de leur p\u00e8re pendant 11 ans, sans que la m\u00e8re ne joue un r\u00f4le significatif dans leur vie, les enfants n'ont pas eu une relation \u00e0 part enti\u00e8re avec leur m\u00e8re. La Cour d'appel d\u00e9clare qu'il est \u00e0 craindre que cela ne change gu\u00e8re \u00e0 l'avenir. La Cour d'appel juge poignant que le p\u00e8re ait \u00e9loign\u00e9 la m\u00e8re des enfants et les enfants de la m\u00e8re.<\/p>\n<h3><strong>Une punition juste<\/strong><\/h3>\n<p>Les actions du p\u00e8re constituent une infraction p\u00e9nale. Ceci est inscrit dans l'article 279 du droit p\u00e9nal n\u00e9erlandais. Cet article concerne le \"retrait de l'autorit\u00e9\". La Cour d'appel d\u00e9clare qu'en raison de la gravit\u00e9 de l'acte criminel, l'emprisonnement est la seule peine juste. Parce qu'il s'agit d'une longue p\u00e9riode de 11 ans, qui a caus\u00e9 de graves cons\u00e9quences pour la m\u00e8re et les enfants, la cour d\u00e9cide que l'emprisonnement pour une p\u00e9riode de 42 mois est appropri\u00e9 et ordonn\u00e9. La m\u00e8re avait demand\u00e9 \u00e0 la Cour d'appel de lui accorder une demande de dommages et int\u00e9r\u00eats de 15.000 euros. La Cour d'appel a d\u00e9cid\u00e9 que la m\u00e8re a subi des dommages immat\u00e9riels en raison de l'acte criminel du p\u00e8re et a d\u00e9cid\u00e9 que le p\u00e8re doit lui payer 15.000 euros et ses frais juridiques pour cette proc\u00e9dure.<\/p>\n<h3><strong>Qu'est-ce que cela signifie pour les autres parents ?<\/strong><\/h3>\n<p>Cela signifie que dans un cas d'enl\u00e8vement d'enfant, les deux parents doivent se faire conseiller sur l'\u00e9ventualit\u00e9 d'une proc\u00e9dure p\u00e9nale. Cela signifie \u00e9galement qu'une fois qu'un parent a pris la d\u00e9cision d'emmener l'enfant sans le consentement de l'autre parent qui en a la garde, il se peut qu'il n'y ait pas de retour possible, en raison d'une \u00e9ventuelle proc\u00e9dure p\u00e9nale.
