Faut-il un accord pour avoir une \"intention parentale partag\u00e9e\" ?<\/strong><\/p>\n

Dans l'affaire Monasky c. Taglieri, la Cour supr\u00eame a rejet\u00e9 l'argument de Monasky selon lequel un accord r\u00e9el \u00e9tait n\u00e9cessaire pour \u00e9tablir une intention parentale partag\u00e9e.\u00a0<\/strong><\/p>\n

Monasky est un citoyen am\u00e9ricain. Taglieri est un citoyen italien. Ils se sont mari\u00e9s en 2011, alors qu'ils vivaient aux \u00c9tats-Unis. Ils ont d\u00e9m\u00e9nag\u00e9 en Italie en 2013. Malgr\u00e9 les probl\u00e8mes conjugaux et les abus physiques, Monasky est tomb\u00e9e enceinte en 2014. Tagliere a alors d\u00e9m\u00e9nag\u00e9 \u00e0 Lugo, \u00e0 3 heures de route. Cependant, les parties ont continu\u00e9 \u00e0 collaborer pour planifier la naissance de l'enfant en Italie. Elles ont recherch\u00e9 des options de garde d'enfants, achet\u00e9 des fournitures pour b\u00e9b\u00e9 et obtenu une r\u00e9sidence plus grande \u00e0 Milan.<\/p>\n

L'enfant est n\u00e9 en f\u00e9vrier 2015. Puis Monasky a dit \u00e0 Taglieri qu'elle voulait divorcer et qu'elle pr\u00e9voyait de retourner aux \u00c9tats-Unis. Plus tard, Monasky et l'enfant ont rejoint Taglieri \u00e0 Lugo. En mars 2015, Monasky et l'enfant ont d\u00e9m\u00e9nag\u00e9 dans une maison s\u00e9curis\u00e9e pour les violences domestiques. Deux semaines plus tard, Monasky et l'enfant ont d\u00e9m\u00e9nag\u00e9 dans l'Ohio.<\/p>\n

Taglieri a demand\u00e9 au tribunal de district de l'Ohio le retour de l'enfant en Italie en vertu de la Convention de La Haye. Il a fait valoir que l'Italie \u00e9tait le pays de r\u00e9sidence habituelle de l'enfant.<\/p>\n

Pas de plan d\u00e9finitif<\/strong><\/h3>\n

Le tribunal de district a d\u00e9termin\u00e9 que les faits de l'affaire, y compris l'age de l'enfant au moment o\u00f9 elle a \u00e9t\u00e9 emmen\u00e9e aux \u00c9tats-Unis, permettaient de conclure que l'intention commune des parties \u00e9tait d'\u00e9lever l'enfant en Italie et que les parents n'avaient pas de projet d\u00e9finitif de d\u00e9m\u00e9nager aux \u00c9tats-Unis. L'enfant, alors \u00e2g\u00e9 de 2 ans, a \u00e9t\u00e9 renvoy\u00e9 en Italie sous la garde de son p\u00e8re.<\/p>\n

R\u00e9sidence habituelle<\/strong><\/h3>\n

Le terme \"r\u00e9sidence habituelle\" n'est pas d\u00e9fini dans la convention de La Haye. Sa d\u00e9finition est donn\u00e9e par la jurisprudence. Normalement, les tribunaux recherchent le lieu o\u00f9 l'enfant s'est \"acclimat\u00e9\". Cependant, les nourrissons sont g\u00e9n\u00e9ralement consid\u00e9r\u00e9s comme trop jeunes pour s'\u00eatre acclimat\u00e9s quelque part. Par cons\u00e9quent, dans le cas d'un enfant en bas \u00e2ge, les tribunaux recherchent une \"intention parentale partag\u00e9e\" pour d\u00e9terminer la r\u00e9sidence habituelle de l'enfant.<\/p>\n

Port\u00e9e de l'appel<\/strong><\/h3>\n

La question de la r\u00e9sidence habituelle d'un enfant est trait\u00e9e par les tribunaux am\u00e9ricains comme \u00e9tant principalement bas\u00e9e sur les faits. Par cons\u00e9quent, en appel, les d\u00e9terminations factuelles d'un tribunal de premi\u00e8re instance sont g\u00e9n\u00e9ralement examin\u00e9es avec d\u00e9f\u00e9rence et ne sont annul\u00e9es que si la cour d'appel constate une erreur manifeste. Cela a \u00e9galement \u00e9t\u00e9 \u00e9tabli dans cette affaire.<\/p>\n

La Cour supr\u00eame a rejet\u00e9 l'argument de Monasky selon lequel un accord r\u00e9el \u00e9tait n\u00e9cessaire pour \u00e9tablir une intention parentale partag\u00e9e. Le seul fait qu'il n'y ait pas eu d'accord n'\u00e9tait pas d\u00e9terminant pour \u00e9tablir si les parties avaient une \" intention parentale partag\u00e9e \" d'\u00e9lever leur enfant en Italie. La Cour supr\u00eame a d\u00e9clar\u00e9 que la d\u00e9termination de la r\u00e9sidence habituelle d'un enfant d\u00e9pend de l'ensemble des circonstances et qu'un accord r\u00e9el entre les parents n'est pas n\u00e9cessaire pour \u00e9tablir la r\u00e9sidence habituelle. La Cour supr\u00eame a confirm\u00e9 le jugement du sixi\u00e8me circuit selon lequel les conclusions du tribunal de district n'\u00e9taient pas clairement erron\u00e9es et que la d\u00e9cision de retour du tribunal de district devait \u00eatre confirm\u00e9e.<\/p>\n
