{"id":3660,"date":"2020-05-23T14:32:02","date_gmt":"2020-05-23T14:32:02","guid":{"rendered":"https:\/\/familylawyer-thehague.nl\/?p=3660"},"modified":"2023-01-06T21:56:03","modified_gmt":"2023-01-06T20:56:03","slug":"no-pictures-for-father","status":"publish","type":"post","link":"https:\/\/familylawyer-thehague.nl\/fr\/no-pictures-for-father\/","title":{"rendered":"Pas de photos pour le p\u00e8re"},"content":{"rendered":"<h3><strong>Cour d'appel de Den Bosch<\/strong><\/h3>\n<p><a href=\"https:\/\/uitspraken.rechtspraak.nl\/inziendocument?id=ECLI:NL:GHSHE:2020:1452\">30 avril 2020, ECLI:NL:GHSHE:2020:1452<\/a><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Presque 14 ans : \" pas de photos pour le p\u00e8re \".<\/span><\/strong><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\"><strong>Dans cette affaire, le tribunal n\u00e9erlandais a tenu compte de l'avis de la jeune fille de 14 ans pour \u00e9tablir l'obligation de fournir des informations, car fournir des photos d'elle constituerait une atteinte excessive \u00e0 sa vie priv\u00e9e.<\/strong><\/span><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Le p\u00e8re avait demand\u00e9 des dispositions relatives au droit de visite et \u00e0 l'information. Le tribunal avait demand\u00e9 au Conseil de protection de l'enfance de r\u00e9diger un rapport consultatif sur les contacts possibles et sur un dispositif d'information. Le Conseil a recommand\u00e9 que la m\u00e8re fournisse au p\u00e8re des informations sur le mineur deux fois par an, y compris une photo r\u00e9cente du mineur. La demande de droit de visite avait \u00e9t\u00e9 retir\u00e9e par le p\u00e8re.<\/span><\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Conseil consultatif pour la protection de l'enfance<\/span><\/strong><\/h3>\n<p>Le tribunal avait rejet\u00e9 la demande du p\u00e8re de recevoir une photo de la mineure au moins deux fois par an. La m\u00e8re devait informer le p\u00e8re par \u00e9crit deux fois par an sur les questions importantes concernant la mineure et sur son \u00e9tat de sant\u00e9 (\u00e9cole, loisirs, questions m\u00e9dicales). Lors de l'audience au tribunal, le Conseil a d\u00e9clar\u00e9 que l'avis du Conseil avait \u00e9t\u00e9 r\u00e9dig\u00e9 sans que le Conseil ne sache que la mineure souhaitait express\u00e9ment ne pas fournir de photos d'elle au p\u00e8re. Le Conseil a soulign\u00e9 que l'id\u00e9al serait que le p\u00e8re informe la mineure par lettre qu'il comprend sa position et esp\u00e8re qu'\u00e0 l'avenir elle acceptera que des photos lui soient fournies.<\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Art. 1 : 377b alin\u00e9a 1 BW<\/span><\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">L'art. 1 : 377b alin\u00e9a 1 du Code civil n\u00e9erlandais stipule que le parent charg\u00e9 de la garde est tenu d'informer le parent non gardien des questions importantes concernant la personne et les biens de l'enfant. \u00c0 la demande d'un parent, le juge peut \u00e9tablir un r\u00e8glement \u00e0 cet \u00e9gard. En vertu du deuxi\u00e8me paragraphe, si l'int\u00e9r\u00eat de l'enfant l'exige, le juge peut d\u00e9terminer, \u00e0 la demande du parent charg\u00e9 de la garde, ainsi que d'office, que le premier paragraphe n'est pas applicable.<\/span><\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Opinion m\u00e8re et enfant<\/span><\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">La m\u00e8re souligne qu'elle et le mineur sont toujours perturb\u00e9s par la p\u00e9riode de violence domestique qu'ils ont finalement fuie. Elles vivent toujours \u00e0 une adresse secr\u00e8te. La m\u00e8re a peur que le p\u00e8re utilise les photos pour retrouver sa fille. <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">La mineure informe le tribunal qu'elle ne veut aucun contact avec le p\u00e8re. Elle ne veut pas que des photos soient envoy\u00e9es au p\u00e8re. Elle ne veut pas qu'il sache \u00e0 quoi elle ressemble maintenant, car elle a peur qu'il commence \u00e0 la chercher.<\/span><\/p>\n<h3><strong>Arr\u00eat de la Cour<\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">La cour estime que compte tenu de l'\u00e2ge de la mineure, elle a presque 14 ans, son opinion doit \u00eatre prise au s\u00e9rieux lors de l'\u00e9valuation de la demande du p\u00e8re. Par cons\u00e9quent, la Cour d'appel est d'avis que la fourniture de photos de la mineure au p\u00e8re constitue une violation excessive de sa vie priv\u00e9e et que l'int\u00e9r\u00eat de la mineure s'oppose donc \u00e0 la demande du p\u00e8re.<\/span><\/p>\n<h3><strong>Qu'est-ce que cela signifie pour les autres parents ?<\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Personne ne souhaite que les enfants soient impliqu\u00e9s dans les discussions juridiques entre les parents. Cependant, si un enfant a une opinion fond\u00e9e, il peut \u00eatre important de veiller \u00e0 ce que cette opinion parvienne au juge.
