Que peut-on et ne peut-on pas attendre d'une \u00e9tude sur la parentalit\u00e9 ?<\/span><\/strong><\/p>\n

La recherche sur les limites des parties revient \u00e0 un examen psychologique des parents et cela ne rel\u00e8ve pas des comp\u00e9tences d'un chercheur en parentalit\u00e9. On ne peut pas non plus attendre d'un chercheur en parentalit\u00e9 qu'il m\u00e8ne des recherches sur la (qualit\u00e9 de la) prise en charge. Ce que l'on peut attendre de lui : la recherche sur la parentalit\u00e9 se concentre sur les raisons pour lesquelles le syst\u00e8me parental ne fonctionne pas, donne un aper\u00e7u du comportement des parents et offre aux parents la possibilit\u00e9 de modifier les sch\u00e9mas d'interaction destructeurs qui nuisent aux enfants. En outre, le rapport d'expertise fournit non seulement des informations tr\u00e8s utiles au juge, mais il est \u00e9galement d'une grande aide pour les parents afin de les aider \u00e0 trouver une solution.<\/span><\/strong><\/p>\n

En 2011, les parties se sont s\u00e9par\u00e9es et le plan parental<\/a> a \u00e9t\u00e9 incluse dans la d\u00e9cision en tant qu'annexe \u00e0 la convention. <\/span><\/p>\n

En 2016, les parties ont convenu d'un accord de r\u00e8glement, par lequel de nouveaux accords ont \u00e9t\u00e9 conclus sur le pouvoir de d\u00e9cision exclusif de la m\u00e8re en ce qui concerne les soins et l'\u00e9ducation des enfants, ainsi que le transfert des enfants, \u00e0 moins que des situations aigu\u00ebs mettant en danger la vie des enfants ou des interventions irr\u00e9versibles ne surviennent au cours des enfants. <\/span><\/p>\n

Les parties ont une autorit\u00e9 conjointe. Les enfants ont la r\u00e9sidence principale chez la m\u00e8re. Les enfants font l'objet d'une surveillance depuis juillet 2019. La m\u00e8re a demand\u00e9 au tribunal une autorit\u00e9 unique et une modification du r\u00e9gime de prise en charge. Le tribunal a \u00e9tabli un r\u00e9gime de prise en charge provisoire et a mis l'affaire en instance dans l'attente des rapports d'activit\u00e9 du tuteur familial.<\/span><\/p>\n

Appel<\/strong><\/h3>\n

La m\u00e8re a fait appel de cette d\u00e9cision provisoire. Le p\u00e8re a occasionnellement fait appel. <\/span><\/p>\n

En appel, la m\u00e8re indique que le p\u00e8re souffre de TED\/NS. Qu'il remet en cause les diagnostics des enfants et les m\u00e9dicaments. Et qu'il n'est pas suffisamment impliqu\u00e9 et coop\u00e8re insuffisamment. <\/span><\/p>\n

Le p\u00e8re d\u00e9clare qu'il est tr\u00e8s impliqu\u00e9 et que c'est la m\u00e8re qui travaille souvent contre. <\/span><\/p>\n

L'institution agr\u00e9\u00e9e cesse d'\u00eatre en mesure d'ex\u00e9cuter la d\u00e9cision contest\u00e9e en raison du conflit entre les parents. L'IG souhaite une enqu\u00eate judiciaire sur l'autorit\u00e9, mais aussi la ratification de la d\u00e9cision provisoire contest\u00e9e. Lors de l'audience, le tuteur familial indique qu'il ne voit pas comment am\u00e9liorer la situation existante. Il constate que les parties sont autonomes et ne sont pas ouvertes aux conseils (et instructions) que le tuteur familial donne aux parents. Le conseil de protection de l'enfance se demande lors d'une s\u00e9ance pourquoi l'esprit du tuteur ne joue pas un r\u00f4le plus actif. Par exemple en favorisant la garde temporaire de l'IG, afin que les parents ne puissent temporairement pas se battre entre eux pour des questions de garde. Pendant cette p\u00e9riode, on peut voir comment organiser l'autorit\u00e9, les soins et les t\u00e2ches parentales \/ les contacts entre le p\u00e8re et les enfants.<\/span><\/p>\n

Chercheur en parentalit\u00e9 <\/span><\/strong><\/h3>\n

Le tribunal agit alors de mani\u00e8re approfondie et nomme un tuteur ad litem pour le conseiller sur l'organisation des contacts. En outre, un psychologue est d\u00e9sign\u00e9 comme chercheur en mati\u00e8re de parentalit\u00e9 (conform\u00e9ment \u00e0 l'article 194 du Code de proc\u00e9dure civile n\u00e9erlandais). Il est charg\u00e9, en \u00e9troite collaboration avec l'IG, de faire l'inventaire de ce qui doit \u00eatre fait \/ chang\u00e9 avec la m\u00e8re et le p\u00e8re afin d'\u00e9tablir une forme de parentage coop\u00e9ratif ou, ce qui semble plus appropri\u00e9, parall\u00e8le, ou une autre forme de parentage adapt\u00e9e \u00e0 la situation. A cette fin, l'expert, en coordination avec l'IG et le tuteur ad litem, doit effectuer une recherche sur les possibilit\u00e9s de coparentalit\u00e9 des parents, ou si la coparentalit\u00e9 ne semble plus \u00eatre responsable, sur le r\u00f4le possible de la m\u00e8re, ou du p\u00e8re, ou d'une autorit\u00e9 neutre dans l'exercice de l'autorit\u00e9. <\/span><\/p>\n

Le p\u00e8re souhaite alors que le chercheur en parentalit\u00e9 \u00e9tudie \u00e9galement le syst\u00e8me des enfants et des parties, c'est-\u00e0-dire qu'il doit \u00e9galement mener des recherches sur la prise en charge des enfants ou sur les possibilit\u00e9s et les limites des parties. La question est donc la suivante : quel est l'objectif et la teneur de la recherche sur la parentalit\u00e9 ?<\/span><\/p>\n

T\u00e2che du chercheur en parentalit\u00e9 <\/span><\/strong><\/h3>\n

Le tribunal souligne qu'une enqu\u00eate parentale ne peut aller aussi loin. Cela n'entre pas dans le cadre de l'objectif et de la teneur de la recherche sur la parentalit\u00e9.<\/span><\/p>\n

Cette d\u00e9claration confirme que les juges sont r\u00e9ticents \u00e0 accepter que la situation entre les parents semble imp\u00e9n\u00e9trable. Tous les efforts devraient \u00eatre faits pour essayer d'am\u00e9liorer les rapports et la communication, en particulier si la faible coop\u00e9ration entre les parents est associ\u00e9e \u00e0 des probl\u00e8mes de modalit\u00e9s de contact.
