L'\u00e9pouse est enceinte de 27 semaines du troisi\u00e8me.  R\u00e9cemment, le maire a impos\u00e9 une interdiction de domicile au mari pour une dur\u00e9e de 10 jours, jusqu'au 3 mars 2020. La raison en est que l'homme aurait eu un comportement intimidant, violent et jaloux. Le 12 avril 2020, la femme a quitt\u00e9 la maison car elle ne s'y sentait plus en s\u00e9curit\u00e9. Depuis, elle vit chez ses parents avec les enfants. La femme d\u00e9clare qu'elle ne peut plus rester chez ses parents et qu'il y a une situation d'urgence. Elle demande au tribunal l'usage exclusif de la maison sans divorce.<\/p>\n<div id=\"x_Signature\">\n<h3><strong>En proc\u00e9dure sommaire ?<\/strong><\/h3>\n<div>Le mari fait valoir que la femme doit \u00eatre d\u00e9clar\u00e9e irrecevable, car elle doit pr\u00e9senter ses demandes dans une chambre de recours pr\u00e9liminaire de la chambre de la famille du tribunal. Il s'agit donc d'une proc\u00e9dure de r\u00e9f\u00e9r\u00e9 pr\u00e9alable ou simultan\u00e9e \u00e0 la proc\u00e9dure de divorce.<\/div>\n<\/div>\n<div><\/div>\n<div>En effet, il est courant, dans le cadre d'une proc\u00e9dure de divorce, de statuer sur la <a href=\"https:\/\/familylawyer-thehague.nl\/fr\/division-of-assets\/\">partage des biens matrimoniaux<\/a> et l'utilisation de la <a href=\"https:\/\/familylawyer-thehague.nl\/fr\/marital-dwelling\/\">domicile conjugal<\/a> dans la p\u00e9riode pr\u00e9c\u00e9dant le divorce et peu apr\u00e8s, et, si n\u00e9cessaire, de demander une d\u00e9cision sur l'utilisation provisoire du domicile conjugal dans le cadre d'une proc\u00e9dure de r\u00e9f\u00e9r\u00e9.<\/div>\n<div><\/div>\n<h3><strong>La d\u00e9cision de la Cour<\/strong><\/h3>\n<div>Le tribunal consid\u00e8re que les parties veulent encore donner une chance \u00e0 leur mariage et qu'il n'est pas question de proc\u00e9dure de divorce et que la femme fait valoir une situation d'urgence. La femme est donc recevable dans ses pr\u00e9tentions.<\/div>\n<div><\/div>\n<div>Le tribunal est d'avis que l'int\u00e9r\u00eat de la femme et des enfants lors du retour au foyer l'emporte sur l'int\u00e9r\u00eat du mari \u00e0 pouvoir continuer \u00e0 vivre dans le foyer. Le tribunal estime que la femme peut effectivement demander l'usage exclusif de la maison sans proc\u00e9dure de divorce.<\/div>\n<div id=\"x_Signature\">\n<div>\n<p>Le tribunal a donc d\u00e9cid\u00e9 d'acc\u00e9der \u00e0 la demande de la femme pour une p\u00e9riode de six semaines. Le tribunal a \u00e9galement d\u00e9cid\u00e9 que, si n\u00e9cessaire, la d\u00e9cision peut \u00eatre ex\u00e9cut\u00e9e avec l'aide de la police. Les parties peuvent utiliser ces 6 semaines pour suivre une th\u00e9rapie ou un conseil. Si cela n'aboutit pas, la femme peut demander des mesures provisoires sur la base de l'art. 822, li\u00e9 \u00e0 une proc\u00e9dure de divorce.<\/p>\n<h3><strong>Qu'est-ce que cela signifie pour les autres conjoints ?<\/strong><\/h3>\n<p>En cas de situation d'urgence, les proc\u00e9dures en r\u00e9f\u00e9r\u00e9 peuvent offrir une solution plus rapide que les mesures provisoires dans le cadre d'une proc\u00e9dure de divorce.
