Il a impos\u00e9 une sanction. La grand-m\u00e8re a viol\u00e9 le r\u00e8glement g\u00e9n\u00e9ral n\u00e9erlandais sur la protection des donn\u00e9es (RGPD), car la publication des photos n'\u00e9tait pas une activit\u00e9 purement personnelle ou domestique. <\/strong><\/p>\n<h3><strong>Facebook et Pinterest<\/strong><\/h3>\n<p>La m\u00e8re n'a pas permis \u00e0 la grand-m\u00e8re de mettre des photos de l'enfant sur ses comptes Facebook et Pinterest. Le p\u00e8re, qui vit ailleurs, indique qu'il ne veut pas non plus de photos de son fils sur les m\u00e9dias sociaux.<\/p>\n<h3><strong>Photos r\u00e9alis\u00e9es par vous-m\u00eame<\/strong><\/h3>\n<p>Grand-m\u00e8re d\u00e9clare qu'elle a pris les photos elle-m\u00eame. Et qu'elle n'utilise plus Pinterest depuis longtemps. Elle d\u00e9clare \u00e9galement qu'elle a d\u00e9j\u00e0 supprim\u00e9 presque toutes les photos. Il n'y a plus qu'une seule photo de son petit-fils sur Facebook.<\/p>\n<p>A c\u00f4t\u00e9 de cela, elle d\u00e9clare avoir un lien particulier avec son petit-fils. Il a v\u00e9cu avec elle et son mari de 2012 \u00e0 2019, jusqu'\u00e0 ce qu'il aille vivre avec son p\u00e8re (leur fils). La grand-m\u00e8re demande si elle peut laisser cette seule photo sur Facebook.<\/p>\n<h3><strong>Activit\u00e9 purement personnelle ou domestique<\/strong><\/h3>\n<p>Le tribunal de district a consid\u00e9r\u00e9 que la loi sur le droit d'auteur n'\u00e9tait pas applicable, car la grand-m\u00e8re avait pris les photos elle-m\u00eame. La LVA ne s'applique pas au traitement de donn\u00e9es personnelles par une personne physique dans l'exercice d'une activit\u00e9 purement personnelle ou domestique.<\/p>\n<p>En l'esp\u00e8ce, il n'a pas \u00e9t\u00e9 suffisamment \u00e9tabli comment la grand-m\u00e8re a configur\u00e9 ou prot\u00e9g\u00e9 ses comptes. Il n'est pas non plus clair si les photos peuvent \u00eatre trouv\u00e9es par le biais d'un moteur de recherche tel que Google. En outre, il n'est pas exclu que les photos plac\u00e9es sur Facebook soient diffus\u00e9es et se retrouvent entre les mains de tiers.<\/p>\n<h3><strong>AVG<\/strong><\/h3>\n<p>Le tribunal estime que la LCA et sa loi d'application sont applicables. Celle-ci stipule que l'autorisation du ou des repr\u00e9sentants l\u00e9gaux est n\u00e9cessaire pour publier des photos d'enfants qui n'ont pas encore 16 ans.<\/p>\n<h3><strong>Paiement des p\u00e9nalit\u00e9s<\/strong><\/h3>\n<p>Pour cette raison, le tribunal ordonne \u00e0 la grand-m\u00e8re de retirer les photos de Facebook et lui interdit de publier des photos \u00e0 l'avenir. Une amende de \u20ac 50,- par jour, avec un maximum de \u20ac 1.000,- sera impos\u00e9e. Le tribunal stipule en outre que chaque partie doit payer ses propres frais de justice.<\/p>\n<h3><strong>Qu'est-ce que cela signifie pour les autres (grands)parents ?<\/strong><\/h3>\n<p>Les grands-parents doivent respecter l'autorit\u00e9 des parents et, bien entendu, la vie priv\u00e9e des petits-enfants, sous peine de se voir ordonner par le tribunal de retirer les photos de Facebook. D'un autre c\u00f4t\u00e9, une photo (normale) du petit-fils sur le profil Facebook de la grand-m\u00e8re est-elle vraiment si grave ?<\/p>\n<p>&nbsp;<\/p>\n<p>Pour terminer ce blog sur une note positive, j'aimerais \u00e9galement souligner le r\u00f4le positif que les grands-parents peuvent jouer dans la vie des enfants et l'importance d'inclure les grands-parents dans votre (international) <a href=\"https:\/\/familylawyer-thehague.nl\/fr\/parenting-plan-2\/\">plan parental<\/a> et le potentiel des grands-parents <a href=\"https:\/\/familylawyer-thehague.nl\/fr\/can-grandparents-have-a-visitation-arrangement-with-grandchildren\/\">droit d'acc\u00e8s aux petits-enfants<\/a>.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Court of Gelderland 13 May 2020, ECLI:NL:RBGEL:2020:2521 In this case, the court ruled that the grandmother had to remove the photos and was no longer allowed to post new photos.
