Ces mots sont souvent confondus, mais n'ont pas la m\u00eame signification. <\/span><span lang=\"en\">Permettez-moi de vous donner une br\u00e8ve explication, bas\u00e9e sur le Code p\u00e9nal n\u00e9erlandais. <\/span><\/p>\n<h3><strong><span lang=\"en\">Insulter <\/span><\/strong><\/h3>\n<p><span lang=\"en\">L'injure est une infraction p\u00e9nale. Il peut s'agir d'une injure publique : verbale, dans une lettre ou une image. Il peut \u00e9galement s'agir d'une injure faite \u00e0 une personne devant elle : oralement ou par une action (par exemple, en crachant au visage de la personne). Enfin, l'injure peut consister \u00e0 envoyer ou \u00e0 remettre une insulte par \u00e9crit ou par image. L'injure est punie par l'art. 266 du Code p\u00e9nal. Outre le caract\u00e8re insultant de la d\u00e9claration, de l'image ou du comportement, il faut \u00e9galement prouver l'intention du suspect d'insulter. <\/span><\/p>\n<h3><strong><span lang=\"en\">Diffamation <\/span><\/strong><\/h3>\n<p><span lang=\"en\">La diffamation implique des d\u00e9clarations qui tentent consciemment de ternir la r\u00e9putation d'une personne en l'accusant de certains comportements. Elle est \u00e9rig\u00e9e en infraction \u00e0 l'art. 261 du code p\u00e9nal n\u00e9erlandais. Il n'est pas n\u00e9cessaire que ces accusations soient des infractions p\u00e9nales. Par exemple, la diffamation peut \u00eatre une accusation de tricherie. La diffamation ne doit pas n\u00e9cessairement se produire en public, mais l'auteur doit avoir pour objectif d'attirer l'attention d'autrui sur ses accusations. Il peut donc \u00e9galement s'agir d'un simple courrier \u00e9lectronique adress\u00e9 \u00e0 la famille ou aux amis. La diffamation n'est pas punissable si l'auteur a agi par n\u00e9cessit\u00e9 de d\u00e9fense ou aurait pu supposer de bonne foi que l'accusation \u00e9tait vraie et que l'int\u00e9r\u00eat public exigeait la divulgation. <\/span><\/p>\n<h3><strong><span lang=\"en\">Calomnie <\/span><\/strong><\/h3>\n<p><span lang=\"en\">Dans le cas de la diffamation, l'accusation est port\u00e9e en public, alors qu'il est connu que l'accusation est fausse (art. 262 du code p\u00e9nal n\u00e9erlandais). La diff\u00e9rence est donc que la diffamation et la calomnie visent des tiers et accusent quelqu'un de ces tiers. Dans le cas de la calomnie, cela se produit \u00e9galement alors que l'auteur sait que l'accusation n'est pas correcte. <\/span><\/p>\n<h3><strong><span lang=\"en\">Dommages et int\u00e9r\u00eats <\/span><\/strong><\/h3>\n<p><span lang=\"en\">Lorsqu'une affaire p\u00e9nale suit la d\u00e9claration, une indemnisation peut \u00eatre demand\u00e9e dans cette affaire p\u00e9nale. Si l'affaire est simple, le juge p\u00e9nal peut prendre une d\u00e9cision \u00e0 ce sujet. Une condamnation avec sursis, assortie d'une p\u00e9riode de probation, peut \u00e9galement \u00eatre impos\u00e9e pour \u00e9viter une r\u00e9cidive. <\/span><\/p>\n<p>En plus d'\u00eatre un d\u00e9lit p\u00e9nal, ce type de comportement peut \u00e9galement constituer un acte illicite (article 6:162 du code civil n\u00e9erlandais).
