Faire de fausses accusations dans un proc\u00e8s familial est un d\u00e9lit p\u00e9nal si le d\u00e9clarant savait au moment o\u00f9 il a fait sa d\u00e9claration que l'accusation n'\u00e9tait pas vraie (art. 188 du code p\u00e9nal n\u00e9erlandais). Dans la pratique, le fait de signaler qu'une personne a fait une fausse d\u00e9claration entra\u00eene rarement des poursuites ou une condamnation. Le simple fait qu'un acquittement ait suivi ne signifie pas qu'il y a eu une fausse d\u00e9claration. Il est tr\u00e8s difficile pour un procureur d'obtenir les preuves et de demander une condamnation pour fausse d\u00e9claration.<\/p>\n

Condamnation p\u00e9nale<\/strong><\/h3>\n

En cas de condamnation pour fausse d\u00e9claration, le montant de la peine d\u00e9pend, entre autres, des cons\u00e9quences de la fausse d\u00e9claration. Le suspect a-t-il \u00e9t\u00e9 plac\u00e9 en d\u00e9tention ou a-t-il subi d'autres dommages graves ? Les contacts entre le suspect et les enfants ont-ils \u00e9t\u00e9 interrompus ?<\/p>\n

Ali\u00e9nation parentale<\/strong><\/h3>\n

Une fausse d\u00e9claration fait souvent partie d'une bataille plus large, par exemple entre des ex-partenaires qui se disputent les enfants. La fausse d\u00e9claration peut alors \u00eatre li\u00e9e \u00e0, par exemple :<\/p>\n

- diffamation et calomnie
\n- des informations incorrectes fournies par un sauveteur
\n- ne coop\u00e8re pas avec l'accord de visite
\n- retrait de l'autorit\u00e9
\n- enl\u00e8vement d'enfants
\n- ali\u00e9nation parentale
\n- influencer les t\u00e9moins (les enfants.<\/p>\n

Que pouvez-vous faire si vous \u00eates confront\u00e9 \u00e0 de fausses accusations ?<\/strong><\/h3>\n

Le parent qui porte une fausse accusation le fera aupr\u00e8s des sauveteurs, dans le but de les utiliser pour atteindre son objectif : minimiser le r\u00f4le de l'autre parent.<\/p>\n

Le parent accus\u00e9 peut faire ce qui suit :<\/p>\n

- informer correctement les prestataires de soins
\n- d\u00e9claration de fausse d\u00e9claration
\n- envoyer une convocation
\n- engager une proc\u00e9dure civile pour faire cesser la diffamation et la calomnie
\n- demander une p\u00e9nalit\u00e9
\n- demander un curateur sp\u00e9cial ou une enqu\u00eate de la commission de protection de l'enfance pour voir si ce que le d\u00e9clarant dit et pense est soutenu par les enfants eux-m\u00eames.
\n- demander un placement des enfants hors du foyer, s'il y a ali\u00e9nation parentale, afin que les enfants ne soient plus affect\u00e9s n\u00e9gativement
\n- Demander la r\u00e9sidence principale des enfants, afin que les enfants ne soient plus affect\u00e9s n\u00e9gativement.
\n- Demandes de recherches m\u00e9dicales et psychologiques approfondies sur les enfants dans le cadre d'abus et\/ou de mauvais traitements.<\/p>\n

Agissez rapidement<\/strong><\/h3>\n

Une accusation fausse ou tr\u00e8s peu plausible constitue une menace s\u00e9rieuse pour les int\u00e9r\u00eats de l'autre parent et devrait tirer la sonnette d'alarme.
\nIl faut agir rapidement. Plus le temps passe, plus le d\u00e9clarant peut obtenir ce qu'il veut. Vous avez moins ou pas de contact avec les enfants, les enfants ont subi un lavage de cerveau et d\u00e9pendent du d\u00e9clarant. Et les travailleurs humanitaires et les juges penseront \"et s'il y avait une part de v\u00e9rit\u00e9 dans tout cela ?\".<\/p>\n

Un autre risque est que les prestataires de soins et les juges pensent que la situation d'influence (si l'on veut la supposer) a perturb\u00e9 le mineur de sorte qu'il ne peut pas \u00eatre soudainement confront\u00e9 au parent qui a \u00e9t\u00e9 faussement accus\u00e9.<\/p>\n
