La Convention de La Haye sur l'enl\u00e8vement d'enfants vise \u00e0 garantir le retour imm\u00e9diat des enfants qui ont \u00e9t\u00e9 d\u00e9plac\u00e9s ou retenus ill\u00e9galement dans un \u00c9tat contractant. Le trait\u00e9 sert \u00e0 prot\u00e9ger les enfants, mais aussi \u00e0 prot\u00e9ger les droits de visite existants. Pour ce faire, le tribunal doit savoir quelle est la r\u00e9sidence habituelle de l'enfant.<\/span><\/p>\n

La proc\u00e9dure dans laquelle il est demand\u00e9 \u00e0 la juridiction d'ordonner le retour de l'enfant se d\u00e9roule dans le pays o\u00f9 l'enfant r\u00e9side actuellement. Cette juridiction doit d\u00e9terminer la r\u00e9sidence habituelle de l'enfant. Le pays o\u00f9 il vivait pr\u00e9c\u00e9demment, ou le pays o\u00f9 il r\u00e9side actuellement ? <\/span><\/p>\n

R\u00e9sidence habituelle<\/strong><\/span><\/h3>\n

La Convention sur l'enl\u00e8vement d'enfants ne d\u00e9finit pas la \"r\u00e9sidence habituelle\". L'interpr\u00e9tation de ce terme doit \u00eatre trouv\u00e9e dans la jurisprudence. La Cour de justice de l'Union europ\u00e9enne dit que la r\u00e9sidence habituelle d'un enfant est le lieu o\u00f9 se trouve, en fait, le centre de sa vie. Il s'agit du lieu qui exprime une certaine int\u00e9gration de l'enfant dans un environnement social et familial. Dans des d\u00e9cisions judiciaires ant\u00e9rieures, divers facteurs sont mentionn\u00e9s, qui peuvent en partie d\u00e9terminer la r\u00e9sidence habituelle de l'enfant. <\/span><\/p>\n

Il s'agit notamment de : <\/span><\/p>\n

- La dur\u00e9e, la r\u00e9gularit\u00e9, les circonstances et les raisons du s\u00e9jour dans un pays et de la r\u00e9installation de la famille dans ce pays.<\/span><\/p>\n

- Le lieu et les conditions dans lesquels l'enfant va \u00e0 l'\u00e9cole <\/span><\/p>\n

- Les comp\u00e9tences linguistiques de l'enfant <\/span><\/p>\n

- Les liens familiaux et sociaux de l'enfant dans ce pays.<\/span><\/p>\n

Il peut s'agir de questions pratiques telles que : <\/span><\/p>\n

- L'enfant va-t-il chez le dentiste, le m\u00e9decin g\u00e9n\u00e9raliste dans le pays o\u00f9 il s\u00e9journe actuellement ? <\/span><\/p>\n

- L'enfant est-il membre d'une association sportive ? <\/span><\/p>\n

- L'enfant s'est-il fait des amis ? <\/span><\/p>\n

- L'enfant s'est-il rendu dans ce pays dans un but temporaire, comme des vacances ?<\/span><\/p>\n

Nourrisson<\/strong><\/h3>\n

Dans le cas d'un nourrisson, il faut tenir compte de l'enracinement g\u00e9ographique et familial du parent gardien chez qui l'enfant r\u00e9side actuellement et des liens sociaux et familiaux de ce parent et de l'enfant dans cet \u00e9tat. Lorsque les parents sont s\u00e9par\u00e9s et que l'enfant voit r\u00e9guli\u00e8rement le parent non gardien, l'environnement familial dans lequel l'enfant est int\u00e9gr\u00e9 peut \u00e9galement \u00eatre form\u00e9 par les deux parents. L'intention des parents de s'\u00e9tablir dans un \u00c9tat donn\u00e9 peut \u00eatre prise en consid\u00e9ration, mais elle n'est pas forc\u00e9ment d\u00e9terminante. Le fait que les parents avaient initialement pr\u00e9vu que l'enfant na\u00eetrait dans un autre \u00c9tat, ou que l'enfant a des liens culturels avec un pays, ou a la nationalit\u00e9 d'un pays, n'est pas en soi d\u00e9cisif, mais est pris en compte. <\/span><\/p>\n

Les Pays-Bas <\/span><\/strong><\/h3>\n

Aux Pays-Bas, la Cour supr\u00eame a d\u00e9crit la r\u00e9sidence habituelle comme \u00e9tant : \"le lieu avec lequel l'enfant a les liens sociaux les plus \u00e9troits imm\u00e9diatement avant son transfert\". <\/span><\/p>\n

Pas de r\u00e9sidence habituelle ?<\/span><\/strong><\/h3>\n

En principe, il est \u00e9galement possible qu'aucune r\u00e9sidence habituelle ne puisse \u00eatre \u00e9tablie et que la Convention sur l'enl\u00e8vement d'enfants ne soit donc pas du tout applicable. En effet, il ne peut alors \u00eatre \u00e9tabli que l'enfant avait sa r\u00e9sidence habituelle dans un \u00c9tat contractant. <\/span><\/p>\n

Plusieurs lieux de r\u00e9sidence habituelle ? <\/span><\/strong><\/h3>\n

Il est possible qu'un enfant s\u00e9journe alternativement dans deux pays, soit toujours avec ses deux parents ensemble, qui font \u00e9galement des allers-retours, soit en faisant des allers-retours entre les deux parents qui vivent chacun dans un pays diff\u00e9rent. Depuis 2019, la Cour de La Haye part du principe qu'un enfant ne peut pas avoir deux lieux de r\u00e9sidence habituelle.<\/span><\/p>\n

Conclusion<\/strong><\/h3>\n

Avant d'entamer une proc\u00e9dure d'enl\u00e8vement d'enfant, il faut faire des recherches pour voir s'il existe suffisamment d'arguments et de preuves pour affirmer que la r\u00e9sidence habituelle est ailleurs.
