Si un enfant a \u00e9t\u00e9 enlev\u00e9 par son parent dans un autre pays, l'autre parent peut demander au tribunal de ce pays d'ordonner le retour de l'enfant dans le pays o\u00f9 il vivait avant l'enl\u00e8vement. Le tribunal peut refuser, sur la base de l'exception du risque grave.<\/p>\n

Exception pour risque grave<\/strong><\/h3>\n

Le juge peut refuser de rendre cette ordonnance, au motif qu'il existe un risque s\u00e9rieux que l'enfant dans ce pays soit expos\u00e9 \u00e0 un danger physique ou psychique, ou soit mis dans une condition insupportable de toute autre mani\u00e8re (article 13, paragraphe 1 sous b de la Convention de La Haye sur l'enl\u00e8vement d'enfants). Apr\u00e8s tout, dans ce cas, l'inconv\u00e9nient d'\u00eatre soudainement retir\u00e9 de l'environnement familier est moins grand que l'inconv\u00e9nient d'\u00eatre expos\u00e9 \u00e0 un danger physique ou psychique. Dans les affaires europ\u00e9ennes, ce motif de refus est consid\u00e9r\u00e9 en liaison avec le droit au respect de la vie priv\u00e9e et familiale (article 8 de la Convention europ\u00e9enne des droits de l'homme).<\/p>\n

Quand le juge va-t-il consid\u00e9rer qu'un tel risque existe ?<\/p>\n

Explication restrictive<\/strong><\/h3>\n

La Cour supr\u00eame des Pays-Bas estime que le motif de refus doit \u00eatre interpr\u00e9t\u00e9 de mani\u00e8re restrictive. Il ne s'agit pas de savoir dans quel pays l'int\u00e9r\u00eat sup\u00e9rieur de l'enfant sera servi. Le fait que l'enfant soit enracin\u00e9 dans le pays o\u00f9 il a r\u00e9sid\u00e9 depuis l'enl\u00e8vement n'est pas non plus une raison pour attribuer ce motif de refus. Lorsqu'il existe des raisons de s'inqui\u00e9ter du bien-\u00eatre de l'enfant apr\u00e8s son retour dans son pays d'origine, il n'y a pas de raison en soi de refuser de rendre une d\u00e9cision de retour. Dans ce cas, il faut d'abord v\u00e9rifier si des dispositions ad\u00e9quates et concr\u00e8tes ont \u00e9t\u00e9 prises dans le pays d'origine pour assurer la protection de l'enfant apr\u00e8s son retour.<\/p>\n

Retour sans le parent ravisseur<\/strong><\/h3>\n

Il est possible que le parent ravisseur ne puisse pas retourner dans son pays d'origine, par exemple parce qu'il n'a pas (plus) de visa. Ce n'est pas en soi une raison de supposer un danger psychologique. Le jeune \u00e2ge de l'enfant non plus. Dans tous les cas, d'autres circonstances doivent \u00eatre d\u00e9montr\u00e9es pour d\u00e9montrer le danger ou l'\u00e9tat insupportable.<\/p>\n

Violence domestique<\/strong><\/h3>\n

L'accusation selon laquelle l'enfant sera expos\u00e9 \u00e0 la violence domestique apr\u00e8s son retour dans le pays d'origine est \u00e9galement insuffisante en soi pour faire appel avec succ\u00e8s \u00e0 l'exception du risque grave. En principe, le juge part du principe que dans le pays d'origine, il existe \u00e9galement des organismes et des structures qui offrent une protection \u00e0 l'enfant. Il est donc n\u00e9cessaire de d\u00e9montrer que ces organismes ne sont pas suffisants. Cela peut se faire, par exemple, en montrant que tout a d\u00e9j\u00e0 \u00e9t\u00e9 tent\u00e9 dans le pass\u00e9.<\/p>\n

Pays non s\u00fbrs<\/strong><\/h3>\n

Certains pays sont tout simplement connus comme des pays peu s\u00fbrs. C'est parfois le cas de fa\u00e7on temporaire. Cela ne suffit pas en soi. Il faut vraiment des circonstances suppl\u00e9mentaires qui montrent que l'enfant est en danger.<\/p>\n

Pauvret\u00e9<\/strong><\/h3>\n

Il en va de m\u00eame si l'on soup\u00e7onne que l'enfant vivra dans la pauvret\u00e9 apr\u00e8s son retour. Le simple fait que le parent avec lequel l'enfant vivra dans ce pays n'a ni logement ni revenu est insuffisant. Ici aussi, le tribunal partira en principe du principe que dans le pays d'origine, des dispositions existent pour les personnes qui n'ont ni logement ni revenu et que l'enfant et le parent seront aid\u00e9s.<\/p>\n

L'exception du risque grave<\/h3>\n

Dans une proc\u00e9dure d'enl\u00e8vement, des commentaires g\u00e9n\u00e9raux sur l'enfant, l'autre parent ou le pays d'origine ne suffisent pas. Vous devrez prouver qu'il existe un risque s\u00e9rieux de danger physique ou mental si vous voulez que le tribunal utilise l'exception du risque grave. Les arguments doivent \u00eatre \u00e9tay\u00e9s aussi concr\u00e8tement que possible par des circonstances particuli\u00e8res, ax\u00e9es sur la situation de l'enfant lui-m\u00eame et assorties d'exemples d'incidents et de tentatives concr\u00e8tes d'\u00e9liminer les risques.<\/p>\n
