Abbott v. Abbott<\/strong><\/h3>\n

Wanneer is er sprake van \"voogdij\" in de zin van het Verdrag?<\/strong><\/p>\n

In Abbott v. Abbott besloot de Hoge Raad dat een bijna-exeat<\/em> beschikking een gezagsrecht geeft aan de niet-gezaghebbende ouder in de zin van het Haags Verdrag inzake internationale ontvoering van kinderen.\u00a0<\/strong><\/p>\n

De ouders verhuisden van de VS naar Chili met hun zoon, die later in de VS werd geboren en in Chili scheidde. De rechtbank gaf de moeder de voogdij over hun zoon en stond de vader alleen het bezoekrecht toe. Daarnaast gaf de rechtbank, op verzoek van de moeder, een bijna-exeat<\/em> Orde. Dit bevel verbiedt beide ouders om het kind uit Chili te halen zonder toestemming van beide ouders.<\/p>\n

Ondanks deze opdracht bracht de moeder de zoon naar de VS, zonder toestemming van de vader. De vader vraagt de Amerikaanse rechtbank om een teruggavebevel op basis van het Verdrag van Den Haag. Hij stelt dat de bijna-exeat<\/em> bevel geeft hem een recht van bewaring zoals bedoeld in het verdrag. Zijn advies was gebaseerd op het volgende.<\/p>\n

Bewaring in het verdrag<\/strong><\/h3>\n

Art. 3 van het Verdrag bepaalt dat een \"ongeoorloofde overbrenging\" een overbrenging is \"die een inbreuk vormt op het gezagsrecht; .<\/p>\n

Art. 5 van het Verdrag bepaalt dat tot de gezagsrechten behoren \"de rechten die betrekking hebben op de zorg voor de persoon van het kind en in het bijzonder het recht de verblijfplaats van het kind vast te stellen\".<\/p>\n

De vader betoogt dat het Haags Verdrag het gezagsrecht als een autonoom begrip wilde opvatten, onafhankelijk van de wijze waarop het gezagsrecht in de wetgeving van een bepaald land specifiek is omschreven. Maar de moeder betoogt dat gezagsrechten bevestigende rechten zijn bij het bepalen van de verblijfplaats van een kind, en een bijna-exeat<\/em> is geen bevestigend recht.<\/p>\n

In Abbott v. Abbott besloot het Hooggerechtshof dat de bijna-exeat<\/em> bevel gaf de vader wel een recht op voogdijschap. Dit gaf de vader de mogelijkheid om op basis van kunst de onmiddellijke terugkeer van de zoon te vragen. 12 van het verdrag.<\/p>\n

Bestaande toepassing<\/strong><\/h3>\n

Dit is ook de visie van de andere verdragslanden. Dit sluit aan bij de visie van het Permanent Bureau van het Verdrag van Den Haag inzake internationaal privaatrecht (Permanent Bureau), dat aandringt op een consequente toepassing van het Verdrag om het wederzijds vertrouwen tussen de verdragsluitende landen in stand te houden.<\/p>\n

Voor de lidstaten van de EU (met uitzondering van Denemarken) wordt de draagwijdte van het woord \"gezag\" verduidelijkt in art. 2 sub 11, b van Brussel II bis: \"Het gezag wordt geacht gezamenlijk te worden uitgeoefend indien een van de personen die krachtens een beslissing of van rechtswege de ouderlijke verantwoordelijkheid heeft, de verblijfplaats van het kind niet kan bepalen zonder toestemming van een andere persoon die de ouderlijke verantwoordelijkheid heeft.<\/p>\n

Wat betekent dit voor andere ouders? <\/strong><\/h3>\n

Dit betekent dat ouders met een internationale achtergrond\/leven tijdens een echtscheidingsprocedure of later, wanneer zij vrezen voor een ontvoering van het kind, de rechter kunnen vragen te beslissen dat hun toestemming nodig is voor een internationale verhuizing van het kind. (Dit zal waarschijnlijk worden gebaseerd op het feit dat een internationale verhuizing het bezoekrecht zou belemmeren). Zelfs wanneer er geen gezamenlijk gezag is, geeft een dergelijke beslissing de rechter de mogelijkheid om op grond van het verdrag de onmiddellijke terugkeer te vragen van het kind naar het land van waaruit het werd ontvoerd, indien het kind op een bepaald ogenblik inderdaad naar een ander land wordt ontvoerd.<\/p>\n
