Kan een kind twee gewone verblijfplaatsen hebben?<\/strong><\/p>\n

Het Hof van Beroep in Den Haag is van mening veranderd over dit onderwerp. Het heeft nu besloten dat een kind slechts \u00e9\u00e9n gewone verblijfplaats mag hebben. Ook als de ouders met het kind afwisselend in twee verschillende landen hebben gewoond, kan er maar \u00e9\u00e9n gewone verblijfplaats zijn. Die verblijfplaats is essentieel voor het Hof om te beslissen of het kind al dan niet uit dat land is ontvoerd.<\/strong><\/p>\n

Twee appartementen<\/strong><\/h3>\n

Deze zaak gaat over twee ouders die elkaar in 2016 in Spanje hebben ontmoet. De man huurde daar een appartement. De moeder heeft in Spanje gewoond en staat bij de Nederlandse gemeente geregistreerd als hebbende een adres in Spanje. Hoewel het echtpaar ook in hun appartement in Nederland verblijft, meent het Hof van Beroep dat zij het grootste deel van hun tijd in Spanje doorbrengen.<\/p>\n

Geboren en getogen<\/strong><\/h3>\n

Daarnaast zijn de kinderen in Spanje geboren als gevolg van een wederzijdse beslissing van de ouders. Na hun geboorte verblijven ze maandenlang in Spanje, totdat de moeder de kinderen naar Nederland brengt. Hoewel de vader vanwege zijn andere kinderen tijd in Nederland doorbrengt, en tijd in andere landen voor het bedrijfsleven, is het Hof van Beroep van mening dat Spanje zijn basis was.<\/p>\n

De echtscheidingsaanvraag<\/strong><\/h3>\n

Het Hof van Beroep geeft ook gewicht aan de tekst van het echtscheidingsverzoek van de moeder. Zij heeft de echtscheiding in Nederland aangevraagd en schreef in dat verzoek dat de partijen in 2017 naar Spanje zijn verhuisd, in Spanje hebben gewoond tot de moeder in 2018 naar Nederland vertrok, waar zij nu haar gewone verblijfplaats heeft. Het Hof van Beroep kan deze tekst niet zien als een gerechtelijke erkenning van de gewone verblijfplaats van partijen. Wel acht het Hof deze tekst relevant voor de vaststelling van de gewone verblijfplaats van de kinderen.<\/p>\n

Twee gewone verblijfplaatsen?<\/h3>\n

In een beslissing van het Hof van Beroep van 27 juli 2016 (ECLI:NL:GHDHA:2016:2502<\/a>) had het Hof van Beroep besloten dat het kind dat afwisselend bij elk van de ouders woonde, die in verschillende landen woonden, twee gewone verblijfplaatsen had. In dit latere arrest van 3 april 2019 verwijst het Hof van Beroep naar de arrest van het Hof van Justitie van de Europese Unie<\/a> van 22 december 2010. In dat arrest heeft het Hof van Justitie besloten dat een kind geen twee gewone verblijfplaatsen mag hebben. Deze uitspraak werd gedaan in een zaak op basis van artikel 8 van Brussel II bis, maar het Hof van Beroep nam deze beslissing over met betrekking tot deze zaak op basis van de kunst. 12 van het Verdrag van Den Haag.<\/p>\n

Conclusie<\/strong><\/h3>\n

In deze zaak concludeert het hof van beroep dat de kinderen hun gewone verblijfplaats in Spanje hadden en dat de moeder hen zonder toestemming van de vader naar Nederland heeft meegenomen. Het hof van beroep beslist dat de moeder moet terugkeren naar Spanje.<\/p>\n

Wat betekent dit voor andere ouders?<\/strong><\/h3>\n

De gewone verblijfplaats van de minderjarige moet door het gerecht worden vastgesteld op basis van de specifieke feiten en omstandigheden van elk geval. Aangezien hun gewone verblijfplaats slechts \u00e9\u00e9n gewone verblijfplaats kan zijn, moeten de ouders alle details over dit onderwerp met hun advocaten bespreken om na te gaan welke relevant zijn.\u00a0<\/span><\/p>\n
