Hooggerechtshof van Nederland<\/span><\/strong><\/h3>\n

Het kind komt vast te zitten tussen de ouders, zodat er geen gezamenlijke voogdij kan zijn?<\/strong><\/p>\n

De moeder krijgt het exclusieve gezag niet omdat zij in strijd met de belangen van de dochter handelt door de vader geen enkele mogelijkheid te bieden om bij het leven van de dochter te worden betrokken. Het Hof acht deze beslissing gerechtvaardigd, ook al is voldaan aan het zogenaamde \"gevangen of verloren criterium\", omdat het kind onder toezicht van de kinderbescherming is geplaatst. De Hoge Raad acht deze uitspraak niet in strijd met art. 1: 251a lid 1 BW. Daarom kiest de Hoge Raad voor gezamenlijk gezag ondanks de problemen tussen de ouders<\/span><\/strong><\/p>\n

De rechtbank had het verzoek van de moeder om alleen de voogdij over de dochter te krijgen afgewezen. Het Hof van Beroep had deze beslissing bevestigd.<\/span><\/p>\n

Oudervreemding<\/strong><\/h3>\n

Oudervreemding De Raad voor de Kinderbescherming had geadviseerd om de gezamenlijke voogdij te behouden. De raad was van mening dat de situatie waarin de vader door de moeder uit het leven van de dochter werd verbannen en waarin de oudervervreemding uitsluitend door de moeder werd gecre\u00eberd. De raad verwachtte niet dat de situatie op korte termijn zou verbeteren. De moeder aanvaardt alleen de hulp die zij passend acht. Bovendien handelt de moeder tegen de belangen van de dochter in door de media en de publiciteit op te zoeken. De raad was dan ook zeer bezorgd over de dochter. Niet over de dagelijkse zorg, maar over haar persoonlijke ontwikkeling op lange termijn. De raad overwoog zelfs een buitenhuisplaatsing om de situatie te doorbreken.<\/span><\/p>\n

Gevangen of verloren<\/span><\/strong><\/h3>\n

Het Hof oordeelde dat er een onaanvaardbaar risico bestaat dat de dochter klem komt te zitten of verloren gaat tussen de ouders zonder dat er binnen afzienbare tijd enige verbetering wordt verwacht. Het Hof is echter van oordeel dat het in het belang van de dochter is dat de ouders het gezamenlijke gezag hebben. Volgens het hof van beroep gaat de moeder op grove wijze voorbij aan haar verplichting om de ontwikkeling van de banden tussen de dochter en haar vader te bevorderen. Het Hof is van oordeel dat de moeder zo duidelijk tegen de belangen van de dochter in handelt dat het onverantwoord zou zijn dat zij het alleenrecht op de dochter heeft. Het hof van beroep acht deze beslissing gerechtvaardigd, ook al is voldaan aan het zogenaamde 'gevangen' of 'verloren' criterium, omdat het kind onder toezicht van de kinderbescherming is geplaatst.<\/span><\/p>\n

Getrouwd of niet <\/span><\/strong><\/h3>\n

De Hoge Raad gelooft dat kunst. 1: 253c lid 2 van het Burgerlijk Wetboek (het verkrijgen van alleenstaande voogdijschap door ongehuwde ouders) en kunst. 1: 251 a lid 1 BW (alleenouderlijk gezag na echtscheiding) op dezelfde wijze moet worden uitgelegd. In beide situaties is het gezamenlijk gezag het uitgangspunt en is het alleenzeggenschap de uitzondering. <\/span><\/p>\n

De Hoge Raad is verder van mening dat een verzoek tot het verkrijgen van gezamenlijke voogdijschap kan<\/em> alleen worden afgewezen op de twee genoemde gronden (er wordt voldaan aan het gevangen of verloren criterium of de afwijzing van het verzoek is anderszins in het belang van het kind), maar dat hieruit niet volgt dat het moet<\/em> worden afgewezen als aan een van de voorwaarden is voldaan. Ook voor kunst. 1: 251 a lid 1 van het Burgerlijk Wetboek geldt dat de rechtbank kan<\/em> het gezag te verlenen aan een van de ouders in geval van een echtscheiding als een van de genoemde gronden zich voordoet. In beide situaties (de ouders scheiden \/ de ouders zijn nooit getrouwd geweest) heeft de rechter dus de ruimte om het gezamenlijk gezag te behouden.<\/span><\/p>\n

Gezinsleven<\/strong><\/h3>\n

Tot slot wijst de Hoge Raad erop dat deze uitleg in overeenstemming is met het principe dat dergelijke beslissingen zoveel mogelijk recht moeten doen aan het belang van het kind. In een geval als dit, waarin de voogdijouder de andere ouder op geen enkele wijze een opening biedt om betrokken te zijn bij het leven van het kind, is het toewijzen van het gezamenlijk gezag een van de instrumenten die de rechter moet kunnen gebruiken om het recht op gezinsleven tussen het kind en de andere ouder te realiseren. Terwijl het gezamenlijke gezag het risico met zich meebrengt dat het kind klem komt te zitten tussen de twee ouders, leidt alleenvoogdij ertoe dat de andere ouder volledig wordt uitgesloten van het leven van het kind. Te oordelen naar de situatie op het moment van zijn beslissing, moet de rechter dan de ruimte hebben om in te schatten welk van de twee kwaden waarschijnlijk het minst schadelijk is voor het belang van het kind.<\/span><\/p>\n

Wat betekent dit voor andere ouders? <\/span><\/strong><\/h3>\n

Deze uitspraak van de Hoge Raad is belangrijk voor ouders die vechten tegen ouderlijke vervreemding, omdat het betekent dat ouderlijke vervreemding niet wordt beloond met eenhoofdig gezag. De rechter kan ervoor kiezen de gezamenlijke voogdij<\/a> ondanks de problemen tussen de ouders. Dat een dergelijke beslissing gepaard gaat met een ondertoezichtstelling is in het belang van het kind, omdat anders weinig verbetering te verwachten valt.<\/span><\/p>\n
