Chafin v. Chafin<\/strong><\/h3>\n

Hooggerechtshof van de Verenigde Staten, 19 februari 2013<\/a><\/p>\n

Is het beroep nutteloos, als het kind al terug is?<\/strong><\/p>\n

In Chafin v. Chafin heeft de U.S. Supreme Court besloten dat een beroepsprocedure niet betwistbaar wordt als het kind in afwachting van het hoger beroep wordt teruggestuurd.\u00a0<\/strong><\/p>\n

In dit geval had de districtsrechtbank in Alabama besloten dat het kind moet worden teruggestuurd naar Schotland. Jeffrey, de vader was een Amerikaanse soldaat. Hij trouwde in Schotland met Lynne, waar hun dochter werd geboren. Toen Jeffrey in Afghanistan diende, ging de dochter bij de moeder in Duitsland wonen. Na de terugkeer van de vader ging de familie in Alabama wonen. In 2010 heeft de vader een echtscheiding aangevraagd. Hij vroeg ook om een tijdelijke kostprijscalculatie nadat de moeder was gearresteerd voor geweldpleging in de woning.<\/p>\n

Gewone verblijfplaats in Schotland<\/strong><\/h3>\n

Na haar arrestatie werd de moeder gedeporteerd, omdat het duidelijk werd dat ze haar visum had overschreden. Vervolgens vroeg de moeder aan de Amerikaanse rechtbank om te beslissen dat de dochter naar Schotland moest worden teruggestuurd, zodat een Schotse rechtbank over de voogdij kon beslissen. De moeder beweerde dat het kind zijn gewone verblijfplaats in Schotland had.<\/p>\n

Verzoek tot verblijf<\/strong><\/h3>\n

De rechtbank heeft vervolgens haar verzoek ingewilligd en de vader veroordeeld tot betaling van de advocaatkosten van de moeders. Daarna kondigde de vader zijn voornemen aan om tegen de beslissing in beroep te gaan en vroeg hij om het bevel van de rechtbank op te schorten totdat het beroep werd behandeld. De rechtbank weigerde echter de uitspraak op te schorten in afwachting van het beroep. Diezelfde dag vertrok de dochter naar Schotland.<\/p>\n

De zaak is betwistbaar.<\/strong><\/h3>\n

Het Amerikaanse Hof van Beroep weigerde zijn uitdaging te horen. Het verklaarde dat de zaak betwistbaar was, gezien het feit dat de dochter al naar Schotland was teruggekeerd. Als gevolg daarvan wees het hof van beroep zijn beroep af en beval het districtshof in plaats daarvan het bevel tot teruggave te geven en de hele zaak te verwerpen.<\/p>\n

Vervolgens ging de vader in beroep bij het Hooggerechtshof, dat de zaak aanvaardde. Een van de redenen om de zaak te aanvaarden, was dat een ander Hof van Beroep in 2013 had geoordeeld dat de gerechtshoven in dergelijke situaties wel bevoegd bleven.<\/p>\n

Het Verdrag van Den Haag gaat niet in op deze situatie.<\/p>\n

Nog steeds jurisdictie<\/strong><\/h3>\n

Het Hooggerechtshof concludeerde dat de Amerikaanse rechtbanken nog steeds bevoegd zijn en dat het Amerikaanse rechtssysteem de moeder nog steeds kan bevelen het kind terug te sturen. Het merkte verder op dat, zelfs als de moeder een negatief resultaat zou negeren, dit op zich niet uitsluit dat de zaak in hoger beroep wordt behandeld, en dat de Schotse rechtbanken die tegelijkertijd over het voogdijgeschil beslissen, door het resultaat van de zaak kunnen worden be\u00efnvloed.<\/p>\n

Wat betekent dit voor andere ouders?<\/strong><\/h3>\n

Het is begrijpelijk dat de moeder de dochter terugbracht naar Schotland zodra ze hoorde dat het verzoek van de vader om te mogen blijven. Als de vader echter met succes beroep had gedaan, zou de dochter naar de VS moeten terugkeren, wat, afhankelijk van haar leeftijd, voor het kind storend zou kunnen zijn (om heen en weer te reizen). Dus, wanneer een ouder moet beslissen of hij of zij al dan niet z.s.m. vertrekt, moet hij of zij rekening houden met het belang van het kind, aangezien de bevoegdheid van het hof van beroep niet zal worden be\u00efnvloed door de onmiddellijke terugkeer van het kind.<\/p>\n
