Het Hof van Beroep veroordeelde hem tot een gevangenisstraf van 42 maanden. Het Hof van Beroep heeft ook besloten dat hij de moeder 15.000 euro aan schadevergoeding moet betalen.\u00a0<\/strong><\/p>\n<p>De vader nam de jonge kinderen mee naar Egypte in februari 2005. Hij haalde ze gewoon op van school zonder dat de moeder het wist. Op dat moment waren de kinderen 3 en 8 jaar oud. Hij veranderde hun naam. Later verhuisde hij met hen mee naar Soedan, terug naar Egypte en vervolgens naar het Verenigd Koninkrijk. Hij heeft de moeder nooit op de hoogte gebracht van hun verblijfplaats. Daardoor kon ze geen contact hebben met haar kinderen.<\/p>\n<h3><strong>Verschillende namen en locaties<\/strong><\/h3>\n<p>In januari 2008 kreeg de moeder het exclusieve gezag over de kinderen. Later, in 2016, slaagde ze erin hun adres te vinden. Ze zag haar kinderen dat jaar voor het eerst sinds ze bij haar werden weggehaald. Maar ze kreeg nauwelijks contact met de kinderen. De rechtbank concludeerde dat de kinderen, na 11 jaar volledig afhankelijk te zijn geweest van hun vader, zonder dat de moeder een rol van betekenis heeft gespeeld in hun leven, geen volwaardige relatie hadden met hun moeder. Het Hof stelt dat gevreesd moet worden dat dit in de toekomst niet veel zal veranderen. Het Hof vindt het schrijnend dat de vader de moeder bij de kinderen heeft weggehaald en de kinderen bij de moeder.<\/p>\n<h3><strong>Gewoon een straf.<\/strong><\/h3>\n<p>Het handelen van de vader is strafbaar. Dit staat in artikel 279 van het Nederlandse Strafrecht. Dit artikel gaat over de 'onttrekking aan het gezag', het Hof stelt dat vanwege de ernst van het strafbaar feit de denkbeeldige gevangenisstraf de enige rechtvaardige straf is. Omdat het gaat om een lange periode van 11 jaar, die ernstige gevolgen heeft gehad voor de moeder en de kinderen, besluit het hof dat een gevangenisstraf van 42 maanden passend is en wordt bevolen. De moeder had het Hof van Beroep gevraagd haar een schadeclaim van 15.000 euro toe te kennen. Het Hof van Beroep heeft besloten dat de moeder immateri\u00eble schade heeft geleden als gevolg van de criminele daad van de vader en heeft besloten dat de vader haar 15.000 euro en haar juridische kosten voor deze procedure moet betalen.<\/p>\n<h3><strong>Wat betekent dit voor andere ouders?<\/strong><\/h3>\n<p>Het betekent dat in een geval van kinderontvoering beide ouders advies moeten krijgen over de mogelijke strafrechtelijke procedure. Het betekent ook dat als een ouder eenmaal die stap zet om het kind zonder toestemming van de andere voogdijouder te nemen, er misschien 'geen weg terug' is, vanwege een mogelijk strafproces.
