Monasky v. Taglieri<\/strong><\/h3>\n

Heb je een overeenkomst nodig om 'gedeelde ouderlijke intentie' te hebben?<\/strong><\/p>\n

In Monasky v. Taglieri verwierp het Hooggerechtshof het argument van Monasky dat er een daadwerkelijke overeenkomst nodig was om een gedeelde ouderlijke intentie vast te stellen.\u00a0<\/strong><\/p>\n

Monasky is een Amerikaanse burger. Taglieri een Italiaanse burger. Ze zijn getrouwd in 2011, toen ze in de VS woonden. In 2013 zijn ze naar Itali\u00eb verhuisd. Ondanks huwelijksproblemen en fysieke mishandeling werd Monasky in 2014 zwanger. Tagliere verhuisde toen naar Lugo, dat was 3 uur rijden. De partijen bleven echter samenwerken om plannen te maken voor de geboorte van het kind in Itali\u00eb. Ze onderzochten de mogelijkheden voor kinderopvang, kochten babybenodigdheden en kregen een groter verblijf in Milaan.<\/p>\n

Het kind is geboren in februari 2015. Toen vertelde Monasky aan Taglieri dat ze wilde scheiden en dat ze verwachtte terug te keren naar de VS. Later kwamen Monasky en het kind bij Taglieri in Lugo. In maart 2015 verhuisden Monasky en het kind naar een veilig huis voor huiselijk geweld. Twee weken later verhuisden Monasky en de baby naar Ohio.<\/p>\n

Taglieri heeft een verzoekschrift ingediend bij de rechtbank in Ohio voor de terugkeer van het kind naar Itali\u00eb in het kader van het Verdrag van Den Haag. Hij stelde dat Itali\u00eb het land is waar het kind zijn gewone verblijfplaats heeft.<\/p>\n

Geen definitief plan<\/strong><\/h3>\n

De districtsrechtbank stelde vast dat de feiten van de zaak, met inbegrip van de kinderjaren op het moment dat het kind naar de VS werd gebracht, de conclusie ondersteunden dat het de gezamenlijke bedoeling van de partijen was om het kind in Itali\u00eb op te voeden en dat de ouders geen definitief plan hadden om naar de VS te verhuizen. Het kind, dat toen 2 jaar oud was, werd teruggestuurd naar Itali\u00eb, waar het onder de hoede van haar vader stond.<\/p>\n

Gewone verblijfplaats<\/strong><\/h3>\n

De term \"gewone verblijfplaats\" is niet gedefinieerd in het Verdrag van Den Haag. De definitie wordt gegeven in de jurisprudentie. Normaal gesproken zoekt de rechter de plaats waar het kind 'geacclimatiseerd' is. Kinderen worden echter meestal te jong geacht om ergens te kunnen acclimatiseren. Daarom zoekt de rechter in het geval van een kind naar 'gedeelde ouderlijke bedoelingen' bij het bepalen van de gewone verblijfplaats van het kind.<\/p>\n

Reikwijdte van het beroep<\/strong><\/h3>\n

De kwestie van de gewone verblijfplaats van een kind wordt door de Amerikaanse rechtbanken behandeld als hoofdzakelijk op feiten gebaseerd. Daarom worden in hoger beroep de feitelijke vaststellingen van een rechtbank doorgaans defensief beoordeeld en worden ze alleen tenietgedaan als het hof van beroep een duidelijke fout vindt. Dit is ook in dit geval vastgesteld.<\/p>\n

Het Hooggerechtshof verwierp Monasky's argument dat er een daadwerkelijke overeenkomst nodig was om een gedeelde ouderlijke intentie vast te stellen. Het enkele feit dat er geen overeenkomst was, was niet dispositief met betrekking tot de vraag of de partijen \"gedeelde ouderlijke intentie\" hadden om hun kind in Itali\u00eb op te voeden. De Hoge Raad stelde dat de vaststelling van de gewone verblijfplaats van een kind afhankelijk is van het geheel van omstandigheden en dat een feitelijke overeenkomst tussen de ouders niet nodig is om de gewone verblijfplaats vast te stellen. De Supreme Court bevestigde het arrest van de Sixth Circuit dat de bevindingen van de rechtbank niet duidelijk onjuist zijn en dat het terugkeerbesluit van de rechtbank moet worden bekrachtigd.<\/p>\n

Wat betekent dit voor andere ouders?<\/strong><\/h3>\n

Wanneer je een internationale ontvoeringszaak hebt over een kind, heb je al het bewijs nodig dat je kunt krijgen over de bedoeling van de ouders voor de ontvoering. Het kan gaan om e mails, wat is app berichten, vragen, contracten, bonnetjes, bezoeken aan artsen of andere professionals, browser geschiedenis, verklaringen van familieleden etcetera.<\/p>\n
