{"id":3660,"date":"2020-05-23T14:32:02","date_gmt":"2020-05-23T14:32:02","guid":{"rendered":"https:\/\/familylawyer-thehague.nl\/?p=3660"},"modified":"2023-01-06T21:56:03","modified_gmt":"2023-01-06T20:56:03","slug":"no-pictures-for-father","status":"publish","type":"post","link":"https:\/\/familylawyer-thehague.nl\/nl\/no-pictures-for-father\/","title":{"rendered":"Geen foto's voor de vader"},"content":{"rendered":"<h3><strong>Hof Den Bosch<\/strong><\/h3>\n<p><a href=\"https:\/\/uitspraken.rechtspraak.nl\/inziendocument?id=ECLI:NL:GHSHE:2020:1452\">30 april 2020, ECLI:NL:GHSHE:2020:1452<\/a><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Bijna 14 jaar oud: \"geen foto's voor vader\"<\/span><\/strong><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\"><strong>In dit geval heeft de Nederlandse rechter bij de vaststelling van de informatieplicht rekening gehouden met het advies van de 14-jarige, aangezien het verstrekken van foto's van haar een buitensporige inbreuk op haar privacy zou zijn.<\/strong><\/span><\/p>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">De vader had gevraagd om een toegangsregeling en een informatieregeling. De rechtbank had de Raad voor de Kinderbescherming gevraagd een advies te schrijven over een eventueel contact en een informatieregeling. De Raad beveelt de moeder aan om de vader twee keer per jaar informatie te geven over de minderjarige, inclusief een recente foto van de minderjarige. Het verzoek om toegangsrecht was door de vader ingetrokken.<\/span><\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Adviesraad voor de bescherming van het kind<\/span><\/strong><\/h3>\n<p>De rechtbank had het verzoek van de vader om minstens twee keer per jaar een foto van de minderjarige te ontvangen, afgewezen. De moeder moest de vader twee keer per jaar schriftelijk informeren over belangrijke zaken van de minderjarige en hoe het met haar gaat (op school, in de vrije tijd, op medisch gebied). Tijdens de zitting van het Hof verklaarde de Raad dat het advies van de Raad was opgesteld, zonder dat de Raad zich ervan bewust was dat het de uitdrukkelijke wens van de minderjarige was om geen foto's van haar aan de vader te overhandigen. De Raad benadrukte dat het voor de vader het meest ideaal zou zijn om de minderjarige per brief te laten weten dat hij haar standpunt begrijpt en hoopt dat zij in de toekomst kan instemmen met het verstrekken van foto's aan de minderjarige.<\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Kunst. 1: 377b lid 1 BW<\/span><\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Kunst. Art. 1: 377b lid 1 van het Burgerlijk Wetboek bepaalt dat de gezagsverantwoordelijke ouder verplicht is de niet-bewaarder te informeren over belangrijke zaken met betrekking tot de persoon en het vermogen van het kind. Op verzoek van een ouder kan de rechter hieromtrent een regeling treffen. Op grond van het tweede lid kan de rechter, indien het belang van het kind dit vereist, op verzoek van de ouder die belast is met het gezag, alsmede ambtshalve, bepalen dat het eerste lid niet van toepassing is.<\/span><\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Advies moeder en kind<\/span><\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">De moeder benadrukt dat zij en de minderjarige nog steeds last hebben van de periode van huiselijk geweld waaruit zij uiteindelijk zijn gevlucht. Ze wonen nog steeds op een geheim adres. De moeder is bang dat de vader de foto's zal gebruiken om de dochter op te sporen. <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">De minderjarige informeert de rechtbank dat ze geen contact met de vader wil. Ze wil niet dat er foto's naar de vader worden gestuurd. Ze wil niet dat hij weet hoe ze er nu uitziet, omdat ze bang is dat hij haar gaat zoeken.<\/span><\/p>\n<h3><strong>Vonnis van het Hof<\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">De rechtbank is van mening dat gezien de leeftijd van de minderjarige, die bijna 14 jaar oud is, haar mening serieus genomen moet worden bij de beoordeling van het verzoek van de vader. Het hof is dan ook van oordeel dat het verstrekken van foto's van de minderjarige aan de vader een excessieve inbreuk op haar privacy vormt en dat het belang van de minderjarige zich daarom verzet tegen het verzoek van de vader.<\/span><\/p>\n<h3><strong>Wat betekent dit voor andere ouders?<\/strong><\/h3>\n<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Niemand wil dat kinderen betrokken raken bij de juridische discussies tussen ouders. Als een kind echter een gegronde mening heeft, kan het belangrijk zijn om ervoor te zorgen dat die mening de rechter bereikt.
