{"id":3708,"date":"2020-06-01T18:38:24","date_gmt":"2020-06-01T18:38:24","guid":{"rendered":"https:\/\/familylawyer-thehague.nl\/?p=3708"},"modified":"2023-01-06T20:46:38","modified_gmt":"2023-01-06T19:46:38","slug":"exclusive-use-of-the-house-without-a-divorce","status":"publish","type":"post","link":"https:\/\/familylawyer-thehague.nl\/nl\/exclusive-use-of-the-house-without-a-divorce\/","title":{"rendered":"Exclusief gebruik van het huis zonder scheiding"},"content":{"rendered":"<h3><strong>Rechtbank Oost-Brabant<\/strong><\/h3>\n<div><a href=\"https:\/\/uitspraken.rechtspraak.nl\/inziendocument?id=ECLI:NL:RBOBR:2020:2309&amp;showbutton=true&amp;keyword=ECLI%3aNL%3aRBOBR%3a2020%3a2309\">20 april 2020, ECLI:NL:RBOBR:2020:2309<\/a><\/div>\n<p><strong><span style=\"font-size: 16px;\">In dit geval vroeg de vrouw de rechtbank in kort geding om het gebruiksrecht van de woning en de voorlopige toewijzing van de kinderen in plaats van in een echtscheidingsprocedure.\u00a0<\/span><\/strong><\/p>\n<p>Partijen zijn in 2017 getrouwd en wonen samen met hun kinderen van twee en drie jaar oud. De vrouw is 27 weken zwanger van de derde.  Onlangs heeft de burgemeester de man een huisverbod opgelegd voor de duur van 10 dagen, tot 3 maart 2020. De reden hiervoor was dat de man zich intimiderend, gewelddadig en jaloers zou hebben gedragen. Op 12 april 2020 heeft de vrouw de woning verlaten omdat zij zich daar niet meer veilig voelde. De vrouw verblijft sindsdien met de kinderen bij haar ouders. De vrouw stelt dat zij niet langer bij haar ouders kan blijven en dat er sprake is van een noodsituatie. Zij vraagt de rechtbank om exclusief gebruik van de woning zonder echtscheiding.<\/p>\n<div id=\"x_Signature\">\n<h3><strong>In kort geding?<\/strong><\/h3>\n<div>De man betoogt dat de vrouw niet-ontvankelijk moet worden verklaard, omdat zij haar vorderingen moet indienen in een kort geding van de familiekamer van de rechtbank. Dus in een kort geding voorafgaand aan of gelijktijdig met een echtscheidingsprocedure.<\/div>\n<\/div>\n<div><\/div>\n<div>Het is immers gebruikelijk om in echtscheidingsprocedures te beslissen over de <a href=\"https:\/\/familylawyer-thehague.nl\/nl\/division-of-assets\/\">verdeling van huwelijksgoederen<\/a> en het gebruik van de <a href=\"https:\/\/familylawyer-thehague.nl\/nl\/marital-dwelling\/\">echtelijke woning<\/a> in de periode tot en kort na de echtscheiding, en zo nodig in een kort geding een beslissing te vragen over het voorlopig gebruik van de echtelijke woning.<\/div>\n<div><\/div>\n<h3><strong>De beslissing van het hof<\/strong><\/h3>\n<div>De rechtbank overweegt dat partijen hun huwelijk nog een kans willen geven en dat er geen sprake is van een echtscheidingsprocedure en dat de vrouw stelt dat er sprake is van een noodsituatie. De vrouw is daarom ontvankelijk in haar vorderingen.<\/div>\n<div><\/div>\n<div>De rechtbank is van oordeel dat het belang van de vrouw en de kinderen bij terugkeer in de woning zwaarder weegt dan het belang van de man om in de woning te kunnen blijven wonen. Het hof vindt dat de vrouw inderdaad het exclusieve gebruik van de woning kan vragen zonder echtscheidingsprocedure.<\/div>\n<div id=\"x_Signature\">\n<div>\n<p>De rechtbank heeft daarom besloten dat het verzoek van de vrouw zal worden ingewilligd voor een periode van 6 weken. De rechtbank heeft ook besloten dat de beslissing zo nodig met behulp van de politie ten uitvoer kan worden gelegd. Partijen kunnen deze 6 weken gebruiken om therapie of begeleiding te krijgen. Als dit niet lukt, kan de vrouw voorlopige maatregelen vragen op grond van art. 822, verbonden aan een echtscheidingsprocedure.<\/p>\n<h3><strong>Wat betekent dit voor andere echtgenoten?<\/strong><\/h3>\n<p>Als er sprake is van een noodsituatie, kan een kort geding een snellere oplossing bieden dan een kort geding in het kader van een echtscheidingsprocedure.
