Hij legde een boete op. De grootmoeder overtrad het AVG, omdat het plaatsen van de foto's geen zuiver persoonlijke of huishoudelijke activiteit was. <\/strong><\/p>\n<h3><strong>Facebook en Pinterest<\/strong><\/h3>\n<p>De moeder stond niet toe dat de grootmoeder foto's van het kind op haar Facebook- en Pinterest-accounts plaatste. De vader, die elders woont, geeft aan dat ook hij geen foto's van zijn zoon op sociale media wil.<\/p>\n<h3><strong>Zelfgemaakte foto's<\/strong><\/h3>\n<p>Oma zegt dat ze de foto's zelf heeft genomen. En dat ze Pinterest al heel lang niet meer gebruikt. Ze verklaart ook dat ze bijna alle foto's al verwijderd heeft. Nu staat er nog maar \u00e9\u00e9n foto van haar kleinzoon op Facebook.<\/p>\n<p>Daarnaast geeft ze aan dat ze een speciale band heeft met haar kleinzoon. Hij heeft van 2012 tot 2019 bij haar en haar man gewoond, totdat hij bij zijn vader (hun zoon) ging wonen. De oma vraagt of ze deze ene foto op Facebook mag achterlaten.<\/p>\n<h3><strong>Puur persoonlijke of huishoudelijke activiteit<\/strong><\/h3>\n<p>De rechtbank was van oordeel dat de Auteurswet niet van toepassing was, omdat de grootmoeder de foto's zelf had gemaakt. De AVG is niet van toepassing op de verwerking van persoonsgegevens door een natuurlijk persoon in het kader van de uitoefening van een zuiver persoonlijke of huishoudelijke activiteit.<\/p>\n<p>In dit geval is onvoldoende vastgesteld hoe de grootmoeder haar accounts heeft opgezet of beveiligd. Ook is onduidelijk of de foto's via een zoekmachine als Google kunnen worden gevonden. Bovendien valt niet uit te sluiten dat de op Facebook geplaatste foto's worden verspreid en in handen van derden terechtkomen.<\/p>\n<h3><strong>AVG<\/strong><\/h3>\n<p>Het Hof acht de AVG en de uitvoeringswet daarvan van toepassing. Daarin is bepaald dat voor het plaatsen van foto's van kinderen die nog geen 16 jaar zijn, de toestemming van de wettelijke vertegenwoordiger(s) is vereist.<\/p>\n<h3><strong>Boetebetaling<\/strong><\/h3>\n<p>Daarom beveelt de rechtbank dat de grootmoeder foto's van Facebook moet verwijderen en verbiedt haar in de toekomst nog foto's te plaatsen. Er wordt een dwangsom opgelegd van \u20ac 50,- per dag, met een maximum van \u20ac 1.000,-. De rechtbank bepaalt verder dat elke partij haar eigen proceskosten moet betalen.<\/p>\n<h3><strong>Wat betekent dit voor andere (groot)ouders?<\/strong><\/h3>\n<p>Grootouders moeten het gezag van de ouders en natuurlijk de privacy van de kleinkinderen respecteren, of ze lopen het risico dat de rechter hen beveelt foto's van Facebook te verwijderen. Aan de andere kant: is \u00e9\u00e9n (normale) foto van de kleinzoon op het Facebook-profiel van de grootmoeder echt zo erg?<\/p>\n<p>&nbsp;<\/p>\n<p>Om deze blog met een positieve noot af te sluiten, wil ik ook wijzen op de positieve rol die grootouders kunnen spelen in het leven van kinderen en op het belang van het betrekken van grootouders bij uw (internationale) <a href=\"https:\/\/familylawyer-thehague.nl\/nl\/parenting-plan-2\/\">opvoedingsplan<\/a> en het potentieel van grootouders <a href=\"https:\/\/familylawyer-thehague.nl\/nl\/can-grandparents-have-a-visitation-arrangement-with-grandchildren\/\">recht op toegang tot kleinkinderen<\/a>.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Court of Gelderland 13 May 2020, ECLI:NL:RBGEL:2020:2521 In this case, the court ruled that the grandmother had to remove the photos and was no longer allowed to post new photos.
