Deze woorden worden vaak door elkaar gehaald, maar hebben niet dezelfde betekenis. <\/span><span lang=\"en\">Laat me je een korte uitleg geven, gebaseerd op het Wetboek van Strafrecht. <\/span><\/p>\n<h3><strong><span lang=\"en\">Belediging <\/span><\/strong><\/h3>\n<p><span lang=\"en\">Het maken van een belediging is een misdrijf. Het kan een publieke belediging zijn: verbaal, in een brief of foto. Het kan ook een belediging zijn van een persoon die voor hem staat: mondeling of door een handeling (bijvoorbeeld door de persoon in het gezicht te spugen). Tot slot kan een belediging bestaan uit het sturen of overhandigen van een belediging op papier of in een afbeelding. Belediging is strafbaar onder de kunst. 266 van het Wetboek van Strafrecht. Naast het beledigende karakter van de verklaring, de beeltenis of het gedrag moet ook de intentie van de verdachte om te beledigen worden bewezen. <\/span><\/p>\n<h3><strong><span lang=\"en\">Smaad <\/span><\/strong><\/h3>\n<p><span lang=\"en\">Bij smaad gaat het om uitspraken die bewust proberen de reputatie van een persoon te bezoedelen door de persoon te beschuldigen van bepaald gedrag. Is gecriminaliseerd in de kunst. 261 van het Wetboek van Strafrecht. Die beschuldiging hoeft geen strafbaar feit te zijn. Smaad kan bijvoorbeeld een beschuldiging van bedrog zijn. Smaad hoeft niet in het openbaar te gebeuren, maar de dader moet wel het doel hebben om de aandacht van anderen te krijgen voor de beschuldigingen. Het kan dus ook gaan om een enkele e-mail aan familie of vrienden. Smaad is niet strafbaar als de dader uit noodzaak van verweer heeft gehandeld of te goeder trouw had kunnen aannemen dat de beschuldiging waar was en dat het openbaar belang openbaarmaking vereiste. <\/span><\/p>\n<h3><strong><span lang=\"en\">Laster <\/span><\/strong><\/h3>\n<p><span lang=\"en\">In geval van laster wordt de tenlastelegging openbaar gemaakt, terwijl bekend is dat de tenlastelegging vals is (art. 262 van het Wetboek van Strafrecht). Het verschil is dus dat smaad en laster gericht zijn tegen derden en iemand de schuld geven aan die derden. In het geval van laster gebeurt dit ook terwijl de dader weet dat de beschuldiging niet juist is. <\/span><\/p>\n<h3><strong><span lang=\"en\">Schades <\/span><\/strong><\/h3>\n<p><span lang=\"en\">Wanneer een strafzaak volgt op de aangifte, kan in die strafzaak schadevergoeding worden gevraagd. Als de zaak eenvoudig is, kan de strafrechter er een beslissing over nemen. Een voorwaardelijke veroordeling, met een proeftijd, kan ook worden opgelegd om herhaling te voorkomen. <\/span><\/p>\n<p>Naast een strafbaar feit kan dit soort gedrag ook een onrechtmatige daad zijn (art. 6:162 BW).
