Wat maakt de leeftijd van het kind uit als het gaat om het Verdrag van Den Haag en een verzoek om het kind terug te sturen naar het land waar het zijn gewone verblijfplaats heeft?<\/p>\n

Artikel 4 van het verdrag<\/strong><\/h3>\n

In de eerste plaats staat in artikel 4 van het verdrag: het verdrag houdt op van toepassing te zijn wanneer het kind de leeftijd van 16 jaar bereikt. Zelfs als de procedure is begonnen voordat het kind 16 jaar wordt, zal er geen terugkeerbesluit worden genomen.<\/p>\n

Weerstand van het kind<\/strong><\/h3>\n

Ten tweede is de leeftijd van het kind van belang wanneer het kind weerstand toont tegen een mogelijke terugkeer. Zoals u weet, kan het verzoek tot terugkeer van het kind door de rechtbank worden geweigerd, als:<\/p>\n

- Het kind woont al meer dan een jaar in dit land en heeft zijn wortels in dat land gezet...
\n- De ouder die de terugkeer aanvraagt, had geen voogdij over het kind, of hij of zij had ingestemd met de verhuizing van het kind.
\n- Er bestaat een groot risico dat de terugkeer van het kind, het kind wordt blootgesteld aan fysieke of psychische schade of dat het kind op een andere manier in een ondraaglijke situatie terechtkomt.
\n- als de rechtbank oordeelt dat het kind tegen zijn terugkeer is en dat het kind van een leeftijd en rijpheid<\/strong>wat rechtvaardigt dat er rekening wordt gehouden met zijn mening.<\/p>\n

Voorkeur?<\/strong><\/h3>\n

Deze laatste zin betekent niet dat het kind mag kiezen. Het hebben van een voorkeur voor een van de landen betekent niet noodzakelijkerwijs dat het kind zich verzet tegen een mogelijke terugkeer. Ook kan de rechtbank proberen te interpreteren wat het kind zegt, in plaats van het letterlijk te nemen.<\/p>\n

Beschermer ad litem<\/strong><\/h3>\n

Wanneer denkt een rechtbank dat een kind een leeftijd en rijpheid heeft die rechtvaardigt dat er rekening wordt gehouden met zijn mening? De rechtbank kan advies vragen aan een psycholoog. Dit wordt een voogdijadvertentie genoemd. Hij of zij wordt door de rechtbank aangesteld om te onderzoeken welke oplossingen in het belang van het kind zijn. De voogd ad litem kan ook een mening hebben over de rijpheid van het kind. De voogd kan worden gevraagd te adviseren over het al dan niet kunnen vormen van een eigen mening van het kind. Het wonen in een ander land met slechts \u00e9\u00e9n van de ouders voor een tijdje, tijdens een gerechtelijke procedure waarbij de ouders tegenstrijdige belangen hebben, kan ertoe leiden dat een kind een kant kiest. Dit kan het gevolg zijn van het isolement en het gevoel afhankelijk te zijn van die ene ouder.<\/p>\n

Kinderinterview<\/strong><\/h3>\n

Het verdrag eist niet dat het gerecht met de minderjarige praat. De EU-landen (met uitzondering van Denemarken) zijn echter wel gebonden aan de verordening Brussel II bis. Artikel 11 van zijn verordening bepaalt dat in een ontvoeringsprocedure het kind in de gelegenheid moet worden gesteld om te worden gehoord.
\nIn de Nederlandse rechtbanken worden kinderen van 12 jaar en ouder normaal gesproken uitgenodigd om hun mening te geven, in een brief of door middel van een kort kinderinterview. In ontvoeringsprocedures wordt de limiet verlaagd tot 6 jaar en ouder. Ouders kunnen de rechtbank specifiek vragen om hun kind uit te nodigen, als het jonger is dan 6 jaar. In andere landen worden kinderen op jongere leeftijd uitgenodigd.<\/p>\n

Uitzondering voor het grafrisico<\/strong><\/h3>\n

Wanneer de rechter moet beslissen of de terugkeer van het kind, het kind zou blootstellen aan fysieke of psychische schade of het anderszins in een ondraaglijke situatie zou brengen, is ook de leeftijd van belang. Het enkele feit dat de terugkeer van een kind het kind waarschijnlijk van de ontvoerende ouder zal scheiden, betekent niet dat het verzoek om terugkeer moet worden afgewezen.<\/p>\n

Ook het loutere feit dat het kind zeer jong is, leidt niet tot die conclusie. Er moeten andere relevante omstandigheden zijn, om te kunnen concluderen dat er sprake is van een ernstig risico, zoals eerder genoemd. Een relevant feit kan zijn dat het kind zich in de hechtingsfase bevindt met de ouder van wie het kan worden gescheiden, bijvoorbeeld door het ontbreken van een visum of verblijfsvergunning<\/p>\n

Gewone verblijfplaats van een zuigeling<\/strong><\/h3>\n

De rechter kan beslissen dat het kind moet worden teruggebracht naar het land waar het zijn gewone verblijfplaats heeft. Dit is de plaats waar in feite het centrum van zijn leven is. Normaal gesproken zal de rechtbank kijken naar zaken als school, activiteiten, medische behandeling, sociale banden enzovoort. Voor een zuigeling is een andere aanpak nodig.<\/p>\n

Gelukkig zijn er veel eerdere rechterlijke uitspraken over het vaststellen van de gewone verblijfplaats van een zuigeling. Als het kind in een bepaald land is geboren, kan het relevant zijn of de ouders aanvankelijk de bedoeling hadden om naar dat land te verhuizen, maar het is ook relevant hoeveel tijd de zuigeling tot de rechterlijke beslissing in dat land heeft doorgebracht, of er culturele banden met dat land zijn en of de zuigeling de nationaliteit van dat land heeft.<\/p>\n

Conclusie<\/strong><\/h3>\n

Ja, de leeftijd van een kind is zeer relevant in een kinderontvoeringsprocedure. En als het kind een kind is, is het nog belangrijker om zo snel mogelijk een verzoek tot terugkeer in te dienen.<\/p>\n
