Zeker tijdens de scheiding van de ouders kunnen zij de kinderen een veilige en stabiele plek bieden, waar zij over de scheiding praten en alle veranderingen verwerken. Maar kunnen grootouders een omgangsregeling hebben met de kleinkinderen?<\/p>\n<h3><strong>Keuze van de kanten <\/strong><\/h3>\n<p>Een echtscheiding kan echter ook grote gevolgen hebben voor het contact tussen grootouders en kleinkinderen. De relatie met de schoonzoon of dochter kan veranderen. Zeker als de scheiding met veel emoties en verwijten is verlopen en de ouders verwachtten dat de grootouders partij zouden kiezen.<\/p>\n<h3><strong>Primaire verblijfplaats <\/strong><\/h3>\n<p>Wanneer de kinderen hun hoofdverblijf hebben bij de schoonzoon of schoondochter en weinig contact hebben met de andere ouder, wordt het voor de grootouders moeilijker om een goed en regelmatig contact te onderhouden. Ook een nieuwe partner van de schoonzoon of schoondochter kan hierbij een rol spelen. Of een verhuizing naar een andere woonplaats.<\/p>\n<p>Maar ook grootouders kunnen daar een positieve rol in spelen. Als een van de ouders tijdelijk geen goede omgangsregeling met de kinderen heeft, kunnen de grootouders helpen. Misschien heeft de ouder in kwestie nog geen nieuwe, kindvriendelijke woonruimte gevonden en kunnen de kinderen nog niet overnachten? Of misschien is de ouder in kwestie tijdelijk instabiel en is de zorg voor de kinderen nog niet toevertrouwd door de andere ouder en\/of de rechter? In dergelijke situaties kunnen grootouders helpen en ook het contact tussen de kleinkinderen en de betrokken ouder bevorderen.<\/p>\n<h3><strong>Co-ouderschap<\/strong><\/h3>\n<p>Soms willen de ouders elkaar een tijdlang niet persoonlijk zien, bijvoorbeeld na (vermeend) huiselijk geweld, en kan de overdracht van de kinderen onaangenaam zijn. In dat geval zouden de grootouders de overdracht kunnen doen. <span lang=\"en\">En natuurlijk is het, ook na een scheiding voor de ouders, soms hard werken om werk te combineren met (gedeelde) zorg voor de kinderen. Dan is het fijn voor de kinderen als er een vertrouwd gezicht komt.<\/span><\/p>\n<p><span lang=\"en\"> Vanwege de positieve rol die grootouders in het leven van de kleinkinderen spelen, is het in Nederland gebruikelijk dat in het ouderschapsplan wordt opgenomen hoe het contact tussen de kinderen en andere familieleden, waaronder de grootouders, wordt onderhouden na een scheiding en ook na het overlijden van een van de ouders. Hulpvaardig zijn is meestal de gemakkelijkste en meest praktische manier om een band met de kleinkinderen te onderhouden.<\/span><\/p>\n<h3><strong>Gerechtelijke procedure<\/strong><\/h3>\n<p><span lang=\"en\">Maar wat moeten grootouders doen als zij geen (voldoende) contact met de kinderen kunnen krijgen? Er bestaat geen wettelijk recht op omgang met de kleinkinderen. De grootouders kunnen naar de rechter stappen om een omgangsregeling met de kleinkinderen te vragen, maar het enkele feit dat zij de grootouders zijn, is niet voldoende om zo'n regeling te krijgen. <\/span><\/p>\n<h3><strong>Nauwe persoonlijke relatie<\/strong><\/h3>\n<p><span lang=\"en\">In Nederland moeten de grootouders aantonen dat zij in een \"nauwe persoonlijke betrekking\" tot het kleinkind staan. Ze moeten aantonen dat er voor de scheiding structureel en regelmatig contact was. Het helpt natuurlijk als de grootouders regelmatig een oppasdag hadden, of als er heel vaak logeerpartijen waren. Dan kan de rechter beslissen of de grootouders recht hebben op een omgangsregeling met de kleinkinderen.\u00a0<\/span><span lang=\"en\">De rechter willigt het verzoek van de grootouders alleen in als hij dit in het belang van de kinderen acht.<\/span><\/p>\n<p><span lang=\"en\"> Soms is de relatie tussen de ouder en de grootouder zo moeilijk geworden dat het opleggen van een bezoekregeling een belasting voor het gezin wordt. Ook met grootouders kan het de moeite waard zijn om bemiddeling te proberen. Dit kan worden geprobeerd voordat een procedure wordt gestart.
