{"id":3989,"date":"2020-06-22T21:22:09","date_gmt":"2020-06-22T21:22:09","guid":{"rendered":"https:\/\/familylawyer-thehague.nl\/?p=3989"},"modified":"2023-07-27T22:48:52","modified_gmt":"2023-07-27T20:48:52","slug":"the-habitual-residence-of-a-child","status":"publish","type":"post","link":"https:\/\/familylawyer-thehague.nl\/nl\/the-habitual-residence-of-a-child\/","title":{"rendered":"De gewone verblijfplaats van een kind"},"content":{"rendered":"<p id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\"> Het Haags Kinderontvoeringsverdrag beoogt de onmiddellijke terugkeer van kinderen die onrechtmatig zijn overgebracht naar of vastgehouden in een verdragsluitende staat. Het verdrag dient ter bescherming van de kinderen, maar ook ter bescherming van het bestaande omgangsrecht. Daartoe moet de rechter weten wat de gewone verblijfplaats van een kind is.<\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">De procedure waarin de rechter wordt verzocht de terugkeer van het kind te gelasten, wordt gevoerd in het land waar het kind op dat moment verblijft. Dat gerecht moet de gewone verblijfplaats van een kind vaststellen. Het land waar het voorheen woonde, of het land waar het nu verblijft? <\/span><\/p>\n<h3 class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\"><strong>Gewone verblijfplaats<\/strong><\/span><\/h3>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">In het Kinderontvoeringsverdrag wordt de 'gewone verblijfplaats' niet gedefinieerd. De interpretatie van het begrip moet in de jurisprudentie worden gevonden. Het Hof van Justitie van de Europese Unie zegt dat de gewone verblijfplaats van een kind de plaats is waar hij of zij in feite het middelpunt van zijn of haar leven vormt. Het gaat om de plaats waar een zekere integratie van het kind in een sociale en familiale omgeving tot uitdrukking komt. In eerdere uitspraken van de rechter worden verschillende factoren genoemd, die mede bepalend kunnen zijn voor de gewone verblijfplaats van het kind. <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Deze omvatten: <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- De duur, regelmaat, omstandigheden en redenen voor het verblijf in een land en de verhuizing van het gezin naar dat land<\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- De plaats en de voorwaarden waaronder het kind naar school gaat <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- De taalvaardigheid van het kind <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- De familie- en sociale banden van het kind in dat land.<\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Dit kan ook praktische zaken omvatten zoals: <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- Gaat het kind naar de tandarts, huisarts in het land waar hij nu verblijft? <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- Is het kind lid van een sportvereniging? <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- Heeft het kind vrienden gemaakt? <\/span><\/p>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">- Is het kind naar dat land gegaan voor een tijdelijk doel, zoals vakantie?<\/span><\/p>\n<h3 id=\"tw-target-text\" class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong>Infant<\/strong><\/h3>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">In het geval van een zuigeling moet rekening worden gehouden met de geografische en familiale wortels van de verzorgende ouder bij wie het kind nu woont en met de sociale en familiale banden van die ouder en het kind in die staat. Wanneer de ouders gescheiden zijn en het kind de niet-verzorgende ouder regelmatig ziet, kan de gezinsomgeving waarin het kind is ge\u00efntegreerd ook door beide ouders worden gevormd. De intentie van de ouders om zich in een bepaalde staat te vestigen kan worden overwogen, maar is mogelijk niet doorslaggevend. Het feit dat de ouders oorspronkelijk de bedoeling hadden dat het kind in een andere staat zou worden geboren, of dat het kind culturele banden heeft met een land, of de nationaliteit van een land heeft, is op zich niet doorslaggevend, maar wordt wel in aanmerking genomen. <\/span><\/p>\n<h3 class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Nederland <\/span><\/strong><\/h3>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">In Nederland heeft de Hoge Raad de gewone verblijfplaats omschreven als: \"de plaats waar het kind de nauwste sociale banden heeft vlak voor zijn overplaatsing.\" <\/span><\/p>\n<h3 class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Geen gewone verblijfplaats?<\/span><\/strong><\/h3>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">In principe is het ook mogelijk dat er geen gewone verblijfplaats kan worden vastgesteld en dat het Kinderontvoeringsverdrag dus helemaal niet van toepassing is. Immers, dan kan niet worden vastgesteld dat het kind zijn of haar gewone verblijfplaats in een verdragsluitende staat had. <\/span><\/p>\n<h3 class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><strong><span lang=\"en\">Meerdere gewone verblijfplaatsen? <\/span><\/strong><\/h3>\n<p class=\"tw-data-text tw-text-large XcVN5d tw-ta\" dir=\"ltr\" data-placeholder=\"Vertaling\"><span lang=\"en\">Het is mogelijk dat een kind afwisselend in twee landen verblijft, ofwel altijd met beide ouders samen, die ook heen en weer reizen, ofwel door heen en weer te reizen tussen de twee ouders die elk in een ander land wonen. Sinds 2019 gaat de rechtbank Den Haag ervan uit dat een kind geen twee gewone verblijfplaatsen kan hebben.<\/span><\/p>\n<h3><strong>Conclusie<\/strong><\/h3>\n<p>Voordat men begint met een kinderontvoeringsprocedure, doet men veel onderzoek om te zien of er genoeg argumenten en bewijzen zijn om te zeggen dat de gewone verblijfplaats elders ligt. Als dat niet kan worden beargumenteerd, is het beter om een ander soort procedure te starten.
