Indien een kind door zijn ouder naar een ander land is ontvoerd, kan de andere ouder de rechter in dat land verzoeken de terugkeer van het kind te gelasten naar het land waar het kind v\u00f3\u00f3r de ontvoering woonde. De rechter kan dit weigeren op grond van de uitzondering wegens ernstig risico.<\/p>\n

Uitzondering voor het grafrisico<\/strong><\/h3>\n

De rechter kan weigeren dat bevel te geven, omdat er een ernstig risico bestaat dat het kind in dat land wordt blootgesteld aan een lichamelijk of geestelijk gevaar, of anderszins in een ondraaglijke toestand wordt gebracht (artikel 13, lid 1 sub b Haags Kinderontvoeringsverdrag). In dat geval is het nadeel van het plotseling worden verwijderd uit de vertrouwde omgeving immers minder groot dan het nadeel van blootstelling aan een lichamelijk of geestelijk gevaar. In Europese zaken wordt deze weigeringsgrond bezien in samenhang met het recht op eerbiediging van priv\u00e9- en gezinsleven (artikel 8 EVRM).<\/p>\n

Wanneer zal de rechter aannemen dat een dergelijk risico bestaat?<\/p>\n

Beperkende verklaring<\/strong><\/h3>\n

De Nederlandse Hoge Raad is van mening dat de weigeringsgrond restrictief moet worden uitgelegd. Het gaat er niet om in welk land het belang van het kind zal worden gediend. Ook het feit dat het kind geworteld is in het land waar het sinds de ontvoering verblijft, is geen reden om deze weigeringsgrond toe te kennen. Wanneer er redenen zijn om bezorgd te zijn over het welzijn van het kind na zijn terugkeer naar het land van herkomst, is er op zich geen reden om de afgifte van een terugkeerbevel te weigeren. In dat geval moet eerst worden onderzocht of in het land van herkomst passende en concrete voorzieningen zijn getroffen om de bescherming van het kind na de terugkeer te verzekeren.<\/p>\n

Terugkeer zonder de ontvoerende ouder<\/strong><\/h3>\n

Het is mogelijk dat de ontvoerende ouder niet naar het land van herkomst kan terugkeren, bijvoorbeeld omdat die ouder geen visum (meer) heeft. Dat is op zichzelf geen reden om psychisch gevaar aan te nemen. Ook de jonge leeftijd van een kind is dat niet. In alle gevallen moeten bijkomende omstandigheden worden aangetoond die het gevaar of de ondraaglijke toestand aantonen.<\/p>\n

Huiselijk geweld<\/strong><\/h3>\n

De beschuldiging dat het kind na terugkeer in het land van herkomst zal worden blootgesteld aan huiselijk geweld is op zichzelf ook onvoldoende om met succes een beroep te doen op de uitzondering voor ernstig risico. De rechter gaat er in beginsel vanuit dat er in het land van herkomst ook instanties en voorzieningen zijn die bescherming bieden aan het kind. Er moet dus worden aangetoond dat deze voorzieningen en instanties naar verwachting niet voldoende zijn. Dit kan bijvoorbeeld door aan te tonen dat in het verleden al van alles is geprobeerd.<\/p>\n

Onveilige landen<\/strong><\/h3>\n

Sommige landen staan gewoon bekend als onveilige landen. Soms is dat tijdelijk het geval. Dat is op zichzelf niet voldoende. Er moeten echt bijkomende omstandigheden zijn die aantonen dat het kind in gevaar is.<\/p>\n

Armoede<\/strong><\/h3>\n

Hetzelfde geldt voor het vermoeden dat het kind na terugkeer in armoede zal leven. Het enkele feit dat de ouder bij wie het kind in dat land zal wonen, geen huisvesting of inkomen heeft, is onvoldoende. Ook hier zal de rechter er in beginsel van uitgaan dat in het land van herkomst voorzieningen bestaan voor mensen die geen huis of inkomen hebben en dat het kind en de ouder geholpen zullen worden.<\/p>\n

De uitzondering voor ernstig risico<\/h3>\n

In een ontvoeringsprocedure volstaan algemene opmerkingen over het kind, de andere ouder of het land van herkomst niet. U zult moeten bewijzen dat er sprake is van een ernstig risico op lichamelijk of geestelijk gevaar als u wilt dat de rechtbank gebruik maakt van de uitzondering voor ernstig risico. De argumenten moeten zo concreet mogelijk worden onderbouwd met bijzondere omstandigheden, toegespitst op de situatie van het kind zelf en voorzien van voorbeelden van incidenten en concrete pogingen om risico's uit te sluiten.<\/p>\n
