Deze verordening bepaalt of de rechtbank in Nederland bevoegd is om een verzoek tot echtscheiding te behandelen.<\/p>\n<p>Volgens artikel 3 bis is de Nederlandse rechter bevoegd indien:<\/p>\n<ul>\n<li>de echtgenoten hun gewone verblijfplaats in Nederland hebben<\/li>\n<li>de echtgenoten hun laatste (gezamenlijke) gewone verblijfplaats in Nederland hadden en een van hen nog steeds in Nederland verblijft<\/li>\n<li>de respondent heeft zijn gewone verblijfplaats in Nederland<\/li>\n<li>de echtgenoten dienen een gezamenlijk verzoek tot echtscheiding in en een van hen heeft zijn gewone verblijfplaats in Nederland.<\/li>\n<li>de verzoeker (verzoekende echtgenoot) heeft zijn gewone verblijfplaats in Nederland <strong>en<\/strong> (s)hij ten minste een jaar onmiddellijk voorafgaand aan de aanvraag in Nederland heeft gewoond<\/li>\n<\/ul>\n<p>of<\/p>\n<ul>\n<li>de verzoeker (verzoekende echtgenoot) heeft zijn gewone verblijfplaats in Nederland <strong>en<\/strong> (s)hij ten minste zes maanden onmiddellijk voorafgaand aan de aanvraag in Nederland heeft gewoond <strong>en<\/strong> heeft de Nederlandse nationaliteit.<\/li>\n<\/ul>\n<p>Krachtens artikel 3 ter is de Nederlandse rechter ook bevoegd indien:<\/p>\n<ul>\n<li>beide echtgenoten hebben de Nederlandse nationaliteit.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Kinderen<\/strong><\/p>\n<p>De Nederlandse rechter zal ook bevoegd zijn om beslissingen over de kinderen te nemen, indien de kinderen hun gewone verblijfplaats in Nederland hebben.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Toepasselijk recht<\/strong><\/p>\n<p>De bevoegdheid om een echtscheidingsbeslissing te geven, impliceert niet automatisch dat de Nederlandse rechter het Nederlandse huwelijksrecht zal toepassen.<\/p>\n<p>Soms hebben echtgenoten samen gekozen welk recht van toepassing zal zijn in geval van echtscheiding.<\/p>\n<p>Als de echtgenoten geen keuze hebben gemaakt, ....<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Lees meer informatie over <a href=\"https:\/\/familylawyer-thehague.nl\/nl\/divorce-4\/\">echtscheiding<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Whether you can have your divorce in the Netherlands is regulated by the Brussels II ter regulation.
