Divorce agreement

If you want to have an amicable divorce in The Netherlands, without a court hearing, you will need to file a divorce agreement. The court will then confirm the agreement in the court decision and attach the agreement to the court decision.

As your mediator, I will:

  • listen to your story and try to understand the background of the relationship, the break up and the the way of communication to which you have become accustomed
  • explore what issues need to be solved
  • explore possible solutions and the pros and cons
  • explain the legal context
  • make calculations on your request
  • write the divorce agreement for you.

When necessary or preferred, (financial or other) experts will be consulted.

The aim is to create a divorce agreement that is not multi-interpretable, that reflects how you came to certain choices, that takes into account any change of circumstances in the future and that gives both parties the feeling that they have equally surrendered something to come to an agreement.

If you have children, the court will also demand a parenting plan, signed by both parties.
