Echtscheiding:
Echtscheidingsconvenant
Als u in Nederland een minnelijke echtscheiding wilt, zonder rechtszitting, moet u een echtscheidingsconvenant indienen. De rechtbank zal het akkoord dan bevestigen in de rechterlijke uitspraak en het akkoord aan de rechterlijke uitspraak hechten.
Als uw bemiddelaar, zal ik:
- luisteren naar uw verhaal en proberen de achtergrond van de relatie, de breuk en de manier van communiceren waaraan u gewend bent geraakt te begrijpen
- onderzoeken welke problemen moeten worden opgelost
- mogelijke oplossingen en de voor- en nadelen te onderzoeken
- de juridische context uitleggen
- berekeningen maken op uw verzoek
- de scheidingsovereenkomst voor je schrijven.
Indien nodig of gewenst zullen (financiële of andere) deskundigen worden geraadpleegd.
Het doel is een echtscheidingsconvenant op te stellen dat niet multi-interpretabel is, dat weergeeft hoe u tot bepaalde keuzes bent gekomen, dat rekening houdt met eventuele verandering van omstandigheden in de toekomst en dat beide partijen het gevoel geeft dat zij evenveel hebben ingeleverd om tot een overeenkomst te komen.
Als u kinderen heeft, zal de rechtbank ook een ouderschapsplan eisen, ondertekend door beide partijen.
