One speaks of acquiescence if, although the other parent did not give prior consent before the child went to live in the other country, he or she later acquiesced. According to the case-law of the European Court of Justice, these must be statements or conduct that clearly and unambiguously show consent.
Where there is acquiescence, no return order will be issued by the court.
